Error Notice. (a) Each settlement report will be deemed final 30 days after the date it is issued, unless the ACO submits to CMS written notice of an error in the mathematical calculations in the settlement report within 30 days after the settlement report is issued (“Timely Error Notice”). (b) Upon receipt of a Timely Error Notice, CMS shall review the calculations in question and any mathematical issues raised by the ACO in its written notice. (c) If CMS issues a written determination that the settlement report is correct, the settlement report is final on the date the written determination is issued.
