Equipment Replacement. (a) The Company shall not require, as a condition of continued hourly employment, that an Employee purchase a truck, tractor and/or trailer, or other vehicular equipment, or that an Employee purchase or assume any proprietary interest or other obligation in the Company business other than where applicable within attached appendices (conversion to owner operator).
Equipment Replacement. Section 31.1. Employees who damage or lose issued equipment or personal property in the line of duty should apply in writing to their immediate supervisor for reimbursement or replacement. The immediate supervisor will investigate the request and turn in an evaluation to the Chief. The Chief will then decide if a requisition or reimbursement shall be made. Each situation will be judged on a case-by-case basis, but replacement or reimbursement shall not be unreasonably denied. If the employee follows this procedure, the Chief will decide the matter and requisition a replacement of comparable value or repair (if the decision is favorable) as soon as possible but in no case later than thirty (30) days of the application. The Chiefs decision shall not be subject to the grievance procedure contained herein.
Equipment Replacement. If replacement of Seller-Provided Equipment is required for any reason, Seller may use refurbished Seller-Provided Equipment and will be replaced on an exchange basis only, and only when the defective equipment has been actually received by Seller.. Returned hardware that has been replaced by Seller will remain Seller property. The following apply with respect to end of life Seller-Provided Equipment:
Equipment Replacement. Except as otherwise provided herein, if any Unit is lost, stolen, destroyed, seized by governmental action or, in Lessee's opinion or Lessor's opinion, damaged ("Event of Loss"), this Lease shall remain in full force and effect without abatement of Rent and Lessee shall promptly replace such Unit at its sole expense with a Unit of equivalent value and utility, and similar kind and in substantially the same condition as the replaced Unit immediately prior to the Event of Loss. Title to such replacement Unit immediately shall vest and remain in Lessor, and such Unit shall be deemed Equipment under this Lease and the applicable Lease Schedule. Lessor shall cause to be paid to Lessee or the vendor of the replacement Unit any insurance proceeds actually received by Lessor as a result of the Event of Loss promptly upon receipt of such proceeds. Lessee shall promptly notify Lessor of any Event of Loss and shall provide Lessor with and shall enter into, execute and deliver such documentation, as Lessor shall reasonably request with respect to the replacement of any such Unit. Notwithstanding the foregoing, if there occurs an Event of Loss which constitutes, in Lessee's opinion, an actual or constructive total loss of all or a substantial portion of the Equipment, then Lessee shall have the option, exercisable upon written notice to Lessor, to terminate this Lease and purchase the Equipment in accordance with Section 21.2; provided, however, that if Lessee opts to purchase the Equipment under Section 21.2, then any insurance proceeds actually received by Lessor as a result of such Event of Loss shall be used to offset the amount due from Lessee to Lessor under Section 21.2 and the excess, if any, shall be promptly paid to Lessee.
Equipment Replacement. If the equipment is inoperable, Contractor, at its option, shall provide a suitable replacement with either new or reconditioned equipment.

Equipment Replacement. PGC, or its duly authorized agent, will maintain a record of equipment in Issuing Agent’s possession by serial number. If Issuing Agent’s equipment malfunctions and must be replaced, PGC or its agent will supply a functional piece of replacement equipment and instructions. Issuing Agent shall follow the instructions furnished with respect to return of the malfunctioning piece of equipment and any peripheral items (cables, etc.). If Issuing Agent does not return a replaced piece of equipment within thirty (30) days of receipt of replacement equipment, Issuing Agent may be charged for the cost of the replacement equipment. PGC may collect equipment charges through EFT in an amount determined by PGC.
