Environmental Site Assessment Report. The Administrative Agent shall have received the Environmental Site Assessment Report.
Environmental Site Assessment Report. Lessor acknowledges receipt of, and its satisfaction with, the Environmental Site Assessment Report prepared for the Premises by GlenFos, Inc., Project No. P1-91311-092799, dated October 11, 1999 (the “Report”). The Report recommends no further subsurface investigation. Prior to the Start Date, Lessor shall remove from the Premises approximately eight (8) 55-gallon drums of liquid referenced in the Report. Lessee shall provide Lessor with a similar report made as of a date which is no earlier than ninety (90) days prior to the termination date of the Lease and Lessee’s vacancy of the Premises and Lessee shall deliver such report to Lessor no later than thirty (30) days prior to the termination date of the Lease and Lessee’s vacancy of the Premises.
Environmental Site Assessment Report. On or prior to the date of the closing of the Loan and the execution of the documents evidencing the Loan, Lxxxxx shall receive the Environmental Report on the Premises conducted by independent consultants. Such Environmental Report must report results satisfactory to Lender in its sole discretion. After review of such report, Lxxxxx may impose further conditions precedent to its obligation to make the Loan hereunder.
Environmental Site Assessment Report. The Administrative Agent shall have received an Environmental Site Assessment Report with respect to the Sites for the Existing Plants and the Aberdeen II Plant, accompanied by a corresponding reliance letter (to the extent such report does not permit reliance thereon by the Senior Secured Parties), each in form and substance satisfactory to the Administrative Agent.
Environmental Site Assessment Report. At the request of the Requisite Lenders from time to time, the Borrower will provide to the Lenders within sixty (60) days after such request, at the expense of the Borrower, an environmental site assessment report for any of the Obligors’ properties described in such request, prepared by an environmental consulting firm reasonably acceptable to the Agent, indicating the presence or absence of Hazardous Materials and the estimated cost of any compliance, removal or remedial action in connection with any Hazardous Materials on such properties; without limiting the generality of the foregoing, if the Agent determines at any time that a material risk exists that any such report will not be provided in the time referred to above, the Agent may retain an environmental consulting firm to prepare such report at the expense of the Borrower, and each of the Obligors hereby grants to the Agent, the Lenders, such firm and any agents or representatives thereof an irrevocable non-exclusive license, subject to the rights of tenants, to enter into their respective properties to undertake such an assessment.

Environmental Site Assessment Report. Unless otherwise waived by Agent, New Borrower or an existing Borrower (at its own expense) shall have delivered to Agent an environmental survey with respect to the Additional Property in form and substance acceptable to Agent in its sole discretion to the extent available. Notwithstanding the foregoing, if requested by Agent, New Borrower or an existing Borrower (at its own expense) shall have delivered to Agent a “Phase I” or other environmental survey of the Property in form and substance acceptable to Agent in its sole discretion. Any environmental survey undertaken by any Borrower and delivered to Agent shall provide that Agent may rely thereon in connection with its making advances hereunder.
Environmental Site Assessment Report. Borrower (at its own expense) shall have delivered to Lender not less than 15 Business Days prior to the date of the making of the Advance the most recent “Phase I” environmental survey in Borrower’s possession of each Additional Resort in form and substance acceptable to Lender. Environmental Site Assessment Report. Except as may have been waived by the Lender, the Debtor (at its own expense) shall have delivered to the Lender not less than 10 Business Days prior to the Closing Date a Phase I environmental survey of the Hilltop Resort. The Phase I environmental survey shall provide that the Lender may rely thereon in connection with its making Advances hereunder.
