Common use of Environmental Liabilities Clause in Contracts

Environmental Liabilities. No action, proceeding, revocation proceeding, amendment procedure, writ, injunction or claim is pending, or to the knowledge of the Company, threatened concerning any Environmental Permit, Hazardous Material or any Company Hazardous Materials Activity. There are no past or present actions, activities, circumstances, conditions, events, or incidents that could involve the Company (or any person or entity whose liability the Company has retained or assumed, either by contract or operation of law) in any environmental litigation, or impose upon the Company (or any person or entity whose liability the Company has retained or assumed, either by contract or operation of law) any environmental liability including, without limitation, common law tort liability.

There are no past or present actions, activities, circumstances, conditions, events, or incidents that could involve the Company or any Subsidiary (or any person or entity whose liability the Company or any Subsidiary has retained or assumed, either by contract or operation of law) in any environmental litigation, or impose upon the Company or any Subsidiary (or any person or entity whose liability the Company or any Subsidiary has retained or assumed, either by contract or operation of law) any environmental liability including, without limitation, common law tort liability.
