Entire Contract; Amendment. This Contract contains the entire agreement between the Parties with respect to its subject matter and supersedes all other prior and contemporaneous contracts and understandings between the Parties, whether oral or written. SRTA shall not be bound by any terms and conditions included in any packaging, invoice, catalog, brochure, technical data sheet, or other document prepared by the TSI Contractor which attempts to impose any condition in variance with or in addition to the terms and conditions contained herein. No amendment to this Contract shall be valid unless made in writing and signed by both Parties.
Entire Contract; Amendment. This contract, including all attachments, if any, constitutes the entire understanding between the parties with respect to the subject matter in this contract. Unless otherwise set forth in this contract, this contract supersedes all other agreements, whether written or oral, between the parties with respect to the subject matter in this contract. No amendment to this contract will be effective unless it is in writing and signed by both parties.
Entire Contract; Amendment. This Contract contains the entire agreement between the Parties. It supersedes any and all prior agreements, contracts, arrangements, or understandings between the Parties on all subjects in any way related to the transaction or occurrence described in this Contract. No oral understandings, statements, promises, or inducements exist contrary to, or inconsistent with, the terms of this Contract. This Contract is subject to modification, waiver, or addition, only by means of a writing signed by the Parties.
Entire Contract; Amendment. This Contract constitutes the entire Contract between the parties and supersedes all prior Contracts and understandings, whether written or oral, relating to the subject matter of this Contract. This Contract may be amended or modified only by a written instrument executed by both IndianRaga and the Participant.
Entire Contract; Amendment. The entire contract between the parties with respect to the Leased Premises is contained in this Lease. This Lease shall be amended only by a written instrument signed by both Landlord and Tenant.
Entire Contract; Amendment. This CONTRACT and any attachments constitute the entire CONTRACT among the parties to it and supersede any prior or contemporaneous understanding or CONTRACT with respect to the services contemplated, and may be amended only by a written amendment executed by both parties. Should the CONTRACT terms conflict with any amendments attached hereto, this CONTRACT shall govern.
Entire Contract; Amendment. This Contract constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes any and all other communications, representations, proposals, understandings or agreements, either written or oral, between the parties with respect to such subject matter. This Contract may not be modified or amended, in whole or in part, except by a writing signed by both parties.
Entire Contract; Amendment. This Lease contains all the agreements, conditions, understanding and representations and warranties made between Landlord and Tenant with respect to the subject matter hereof and may not be amended or modified orally in any manner other than by agreement in writing, signed by both parties hereto or their respective successors in interest. The acceptance or depositing of any payment delivered by Tenant to Landlord i) before the commencement of this Lease shall not be deemed or construed as an acceptance or execution of this Lease by the Landlord, or ii) if after commencement of this Lease, as a waiver of any of Landlord’s right and remedies hereunder or at law or in equity.
Entire Contract; Amendment. This Contract, each PSA, each Bxxx of Sale, and any agreement executed in connection herewith or therewith constitutes the full understanding of the Contractor, on the one hand, and the Companies, on the other hand, and is a complete and an exclusive statement of the terms of their agreement, and will exclusively control and govern all Work performed by Contractor. All representations, offers, and undertakings of the Contractor, on the one hand, and the Companies, on the other hand, made prior to the Effective Date hereof, whether oral or in writing, are merged herein and into each PSA, each Bxxx of Sale, and any agreement executed in connection herewith or therewith. No other contract or agreement, whether executed prior or subsequent to the execution of this Contract, a PSA, a Bxxx of Sale, or any agreement executed in connection herewith or therewith will in any way modify, amend, alter, or change any of the terms or conditions set out herein unless such contract or agreement: (a) is executed by persons of equal position and authority within their respective companies as those executing this Contract, a PSA, a Bxxx of Sale, or any agreement executed in connection herewith or therewith, and (b) clearly expresses the specific intention of the Parties to amend this Contract, a PSA, a Bxxx of Sale, or any agreement executed in connection herewith or therewith by making specific reference thereto.
Entire Contract; Amendment. The foregoing states the entire Contract between the Parties, and supersedes any and all prior understandings, commitments, or agreements, oral or written, with respect to the Project, Statement of Work (Attachment A), Pricing Schedule (Attachment B), Service Level Commitments (Attachment C) or Contract. Upon execution by the duly authorized representatives of the Parties, this Contract will become a mutually binding Contract by and between Customer and OCTO/DC-Net and may not be modified except by a written amendment duly executed by authorized representatives of each Party.
