Enforcement of this Settlement Agreement. The Court will retain jurisdiction, and will have exclusive jurisdiction, to enforce, interpret, and implement this Settlement Agreement and the terms of any order entered pursuant to this Settlement Agreement.
Enforcement of this Settlement Agreement. The terms and conditions of the Settlement Agreement and the implementing Order shall be treated as a final cease and desist order issued by the State Water Board pursuant to chapter 12 of the California Water Code (commencing with section 1825). Violations of this Settlement Agreement and the Order will be subject to enforcement under Water Code section 1845 at the discretion of the State Water Resources Control Board.
Enforcement of this Settlement Agreement. The administrative civil liability required in Paragraph 3, if not paid consistent with the schedule described in Paragraph 4, will be recoverable as provided in Water Code section 1055.4. Failure to comply with the terms of the Cease and Desist Order may result in additional enforcement, which may include imposition of administrative civil liability pursuant to Water Code section 1845.
Enforcement of this Settlement Agreement. If the ACL that Stipulation 5 requires is unpaid after 30 days of the date of the Deputy Director’s finding, the Deputy Director will seek a judgment against the Respondent in accordance with Water Code section 1055.4.
Enforcement of this Settlement Agreement. Failure to comply with the corrective actions described under Stipulation 3 may result in additional enforcement, including imposition of administrative civil liability pursuant to Water Code section 1845.
Enforcement of this Settlement Agreement. If Stipulation 5 is unpaid after 30 days of the date of the Deputy Director’s finding, the Deputy Director will seek a judgment against the Respondent in accordance with Water Code section 1055.4.
Enforcement of this Settlement Agreement. The Court shall retain jurisdiction, and shall have exclusive jurisdiction, to enforce, interpret, and implement this Settlement Agreement, including any alleged violation, and the terms of any order entered pursuant to this Settlement Agreement. However, any dispute or disagreement between the Parties regarding this Agreement and its implementation for purposes of submission to the Court for Preliminary Approval, shall be mediated by the Xxx. Xxxxx X. Andersen.
Enforcement of this Settlement Agreement. If the penalty that Stipulation 3 requires is unpaid after 30 days of the date of the Deputy Director’s finding, the Deputy Director will seek a judgment against the Respondent in accordance with Water Code section 1055.4.
