Enforcement of Terms. No failure on the part of Landlord to enforce any term, covenant or condition herein contained, nor any waiver of any right thereunder by Landlord, unless in writing, shall discharge or invalidate such term, covenant or condition, or affect the right of Landlord to enforce the same in the event of any subsequent breach or default. The consent of Landlord to any act or matter must be in writing and shall apply only with respect to the particular act or matter to which such consent is given and shall not relieve Tenant from the obligation wherever required under this Lease to obtain the consent of Landlord to any other act or matter. The receipt by Landlord of any Rent or any other sum of money or any other consideration hereunder paid by or on behalf of Tenant after the termination, in any manner, of the term of this Lease, or after the giving by Landlord of any notice hereunder to effect such termination, shall not reinstate, continue or extend the term of this Lease or destroy or in any manner impair the efficacy of any such notice of termination as may have been given hereunder by Landlord to Tenant prior to the receipt of any such sum of money or other consideration, unless so agreed to in writing and signed by Landlord. Neither acceptance of the keys nor any other act or thing done by Landlord or any employee, agent or representative of Landlord during the term of this Lease shall be deemed to be an acceptance of a surrender of the Demised Premises, excepting only an agreement in writing signed by Landlord accepting or agreeing to accept such a surrender.
Enforcement of Terms. Supplier agrees that Cisco may, at its discretion, enforce all terms under this Agreement directly, notwithstanding the fact that Orders for the Products may issue from Cisco Authorized Purchasers.
Enforcement of Terms. Failure by either Party to this Agreement at any time or from time to time to enforce any of the provisions of this Agreement shall not be construed to be a waiver of such provision or of such party’s right to thereafter enforce each and every provision hereof.
Enforcement of Terms. The benefits of this Agreement shall inure to, and may be enforced by the County for the full duration of the Affordability Period, whether or not the County shall continue to be the holder of the Mortgage, whether or not the Project loan may be paid in full, and whether or not any bonds issued for the purpose of providing funds for the project are outstanding. Breach of these terms during the Affordability Period shall result in recapture of all SHIP-funds expended on the Project.
Enforcement of Terms. The failure of either party to enforce at any time, any of the provisions of this contract or any rights in respect thereto or to exercise any option herein provided shall, in no way, be construed to be a waiver to such provisions, rights or options or in any way affect the validity of the contract. The exercise by either party, of any of its rights, herein shall not preclude or prejudice either party from exercising the same or any other right it may have hereunder.
Enforcement of Terms. 9.1 The failure of either party to enforce at any time any of the provisions of this Contract or any rights in respect thereto or to exercise any option therein provided, shall in no way be construed to be a waiver of such provisions, rights or options or in any way to affect the validity of the Contract. The exercise by either party of any of its rights herein shall not prejudice either party from exercising the same or any other right it may have under the Contract.
Enforcement of Terms. Plaintiffs, along with all individuals who are impacted by terms of this agreement, may enforce this agreement as third-party beneficiaries and/or intended beneficiaries. In the event that a party to this agreement believes that the terms of the agreement have not been fulfilled, the parties will make a good faith effort to resolve the matter before filing any motion with the court to enforce the agreement.
Enforcement of Terms. Supplier agrees that Cisco may, at its discretion, enforce all terms under this Agreement directly, notwithstanding the fact that Orders for the Products may issue from Cisco Authorized Purchasers. If any Authorized Purchaser makes a claim to Supplier regarding any Product, Parties agree that any claim or enforcement of the terms of this Agreement either by Cisco or the relevant Authorized Purchaser shall bar any other entity from making the same claim or enforcement and any liability arising out of such claim or enforcement. Supplier may notify Cisco in writing if Supplier receives a claim or enforcement request which duplicates a claim or enforcement request that Supplier previously received from another entity.
Enforcement of Terms. In the event of Seller’s enforcement of any of these Terms, Buyer shall be liable to Seller for all costs, including attorneys’ fees, incurred by Seller in enforcing these Terms and in collecting any sums owed by Buyer to Seller.
Enforcement of Terms. In the event the City determines that Access Manager is not in compliance with an obligation of this Agreement, the City may exercise among other remedies, the right to withhold funds payable or offset against funds due to Access Manager any amount required to bring Access Manager into compliance. The City may also exercise its right to terminate the Agreement pursuant to the Termination Section of this Agreement, and appoint another Access Manager. The City may in addition to these remedies exercise any other remedies available to it under law or under this Agreement.
