ENFORCEMENT OF PROVISIONS. This Agreement (1) constitutes my entire agreement with Intelsat with respect to the subject matter hereof, (2) shall be binding on my heirs, executors, administrators, and legal representatives, and (3) shall inure to the benefit of Intelsat's successors and assignees.
ENFORCEMENT OF PROVISIONS. To the extent permitted by applicable law, the Employer and the Administrator shall have the exclusive right to enforce any and all provisions of this Agreement on behalf of all Employees and former Employees of the Employer or their Beneficiaries or other persons having or claiming to have an interest in the Trust Fund or under the Plan. In any action or proceeding affecting the Trust Fund or any property constituting a part or all thereof, or the administration thereof or for instructions to the Trustee, the Employer, the Administrator and the Trustee shall be the only necessary parties and shall be solely entitled to any notice of process in connection therewith; any judgment that may be entered in such action or proceeding shall be binding and conclusive on all persons having or claiming to have any interest in the Trust Fund or under the Plan.
ENFORCEMENT OF PROVISIONS. If any provision of this Agreement is invalid and not enforceable in accordance with its terms, all other provisions which are self-sustaining and capable of separate enforcement without regard to the invalid provision, shall be and continue to be valid and forceful in accordance with their terms.
ENFORCEMENT OF PROVISIONS. The failure of Employer or Employee at any time to enforce any of the provisions of this Agreement, or any right with respect thereto, will in no way be construed to be a waiver of such provisions or rights or in any way to affect the validity of this Agreement. The exercise by either party thereto of any rights under the term or covenants herein shall not preclude or prejudice the exercising thereafter of the same or any other rights under this Agreement.
ENFORCEMENT OF PROVISIONS. All costs and expenses, including attorneys’ fees in a reasonable amount incurred by Landlord or Tenant in any suit, trial or appeal thereof commenced to enforce the obligations of either under this Lease, will be paid by the losing party to the prevailing party upon demand.

ENFORCEMENT OF PROVISIONS. Owner acknowledges that the primary purpose for requiring compliance with the restrictions provided in this Indenture are to assure compliance of the Property and Owner (and its successors and assigns) with Section 42 of the United States Code and the Regulations. Owner, in consideration for receiving Twenty Thousand Three Hundred Twenty & 00/100 Dollars ($20,320) of Community Block Grant Funding, hereby agrees and consents that the (i) City of Rapid City, and/or the United States of America shall be entitled to enforce specific performance by Owner, its successors and assigns, or Article III of this Indenture in addition to all other remedies provided by law or in equity with regard to any breach of said Article III.
ENFORCEMENT OF PROVISIONS. No failure, or successive failures, on the part of the Lessor to enforce any provision, nor any waiver or successive waivers on its part of any provision herein, shall operate as a discharge thereof or render the same inoperative or impair the right of the Lessor to enforce the same upon any renewal thereof or in the event of subsequent breach or breaches.
ENFORCEMENT OF PROVISIONS. The failure to enforce any provision of this Agreement or to require at any time performance by a Partner of any provision of this Agreement shall not in any way be construed to be a waiver of that provision, or to affect either the validity of this Agreement or any part of this Agreement, or the right of any Partner thereafter to enforce each and every provision of this Agreement in accordance with the terms of this Agreement.
ENFORCEMENT OF PROVISIONS. In the event any provision of this agreement shall be found to be void and unenforceable for any reason, such finding shall not effect the validity or enforceability of any of the remaining provisions hereof.
