Energy Services Contracts. Corix will enter into an Energy Services Contract with each NDES Customer. Each such Energy Services Contract (except in the case of any Energy Services Contract between Corix and UBC, the terms and conditions of which will be separately negotiated and settled between the Parties) will be in substantially the form set out in Schedule I. In circumstances in which a Developer is the initial signatory to an Energy Services Contract but is not an NDES Customer in the relevant Building, such Energy Services Contract will be assignable to and enforceable against the NDES Customer(s) in that Building.
