Common use of ENDANGERED SPECIES Clause in Contracts

ENDANGERED SPECIES. Developer agrees to comply with the federal Endangered Species Act. City agrees that the TCEQ optional enhanced measures Appendix A and Appendix B to RG-348 are an approved regional plan acceptable to the United States Fish and Wildlife Service (“USFWS”). The City and Developer agree that by Developer complying with the TCEQ enhanced measures under RG- 348, Developer is also in compliance with WTCPUA rules and policies related to the Endangered Species Act.
