End User Licensing. IMG will use the same End User license agreement for Licensed Client Exec as IMG then uses for Crystal Info, provided that IMG will use reasonable efforts to include provisions similar, as to protection of VERITAS' interests, to Sections 2, 3, and 7 of Exhibit C. It is understood and agreed that, without limitation, this may be (i) a "shrinkwrap" agreement that appears on or in the software package, (ii) an online agreement that appears on the End User screen when the software is first used, and/or (iii) a "web wrap" agreement that appears before, or in connection with, the End User's electronic receipt of the software.
End User Licensing. VERITAS will use the same End User license agreement for Licensed Crystal Reports as VERITAS then uses for the Transferred Product with which it is bundled or in which it is incorporated, provided that VERITAS will use reasonable efforts to include provisions similar, as to protection of Seagate's interests, to Sections 2, 3, and 7 of Exhibit C. It is understood and agreed that, without limitation, this may be (i) a "shrinkwrap" agreement that appears on or in the software package, (ii) an online agreement that appears on the End User screen when the software is first used, and/or (iii) a "web wrap" agreement that appears before, or in connection with, the End User's electronic receipt of the software. VERITAS shall either (i) distribute with each copy of Licensed Crystal Reports distributed by VERITAS or its Distributors a registration card specified by IMG, or (ii) to the extent this information is available to VERITAS, VERITAS shall provide a report to IMG each month of all End Users who have received copies of Licensed Crystal Reports distributed by VERITAS or its Distributors.

It is understood and agreed that, without limitation, this may be (i) a "shrinkwrap" agreement that appears on or in the software package, (ii) an online agreement that appears on the End User screen when the software is first used, and/or (iii) a "web wrap" agreement that appears before, or in connection with, the End User's electronic receipt of the software.
End User Licensing. Licensee agrees that each copy of the software distributed by Licensee hereunder will be accompanied by a copy of Licensee’s standard end user software license; provided, however, that the terms of such license will be drafted so as to apply to the PS Licensed Products and PalmSource Web Browser and shall be at least as protective of the PS Licensed Products as: (i) the terms and conditions Licensee uses for its own software products; (ii) the minimum terms and conditions set forth in Exhibit G (Minimum Terms and Conditions of End User License); and (iii) the terms and conditions governing this Agreement. Licensee agrees to include in such terms and conditions for use outside of the United States any country-specific provisions needed to comply with the foregoing, and agrees to enforce the terms and conditions applicable to the PS Licensed Products contained in such license.
End User Licensing. Licensee agrees that each copy of the software distributed by Licensee hereunder will be accompanied by a copy of Licensee’s standard end user software license; provided, however, that the terms of such license will be drafted so as to apply to the PS Licensed Products and Omega Browser and shall be at least as protective of the PS Licensed Products as: (i) the terms and conditions Licensee uses for its own software products; (ii) the minimum terms and conditions set forth in Exhibit G (Minimum Terms and Conditions of End User License); and
End User Licensing. Each copy of the WPB Software distributed by Company hereunder will require end users to enter into (either electronically or in hard copy) WPB’s then-current End User software license as WPB may provide to Company from time to time.
End User Licensing. Seagate will use an End User license agreement for Software Products that includes provisions similar, as to protection of VERITAS' interests, to Sections 2, 3, and 7 of Exhibit C hereto. It is understood and agreed that, without limitation, this
End User Licensing. Retailers will license the Bundled Application directly to each End User pursuant to Retailers’ end user licensing terms, and Retailers are solely responsible for all aspects concerning the downloading of the Bundled Application by End Users. Retailers will: (i) ensure that its end user licensing terms for the Bundled Application [***] and [***]; (ii) not make any representations, warranties, or promises to End Users regarding the Bundled Application on behalf of or impose any [***] or [***] with respect to the Bundled Application; and (iii) not otherwise represent to End Users or others that [***] of the Bundled Application. Bank shall have the right, upon Bank’s request, to review and provide comments on the form of end user licensing terms for the Bundled Application, and Retailers shall incorporate Bank’s requested changes to the extent reasonable and consistent with this Schedule 2.08.
End User Licensing. The parties agree that all "sales" shall be via mutually agreed upon license agreements only. Both parties will agree on the form of end-user license agreement(s), but agree that all end-user license agreements for Jointly Developed Products shall contain adequate protections and fixed monetary limitations of damages for HYPROTECH and ICARUS, and limitations and disclaimers in the areas of warranty, liability, condition of merchantability or fitness for the purpose, infringement, and appropriate indemnifications. HYPROTECH agrees to utilize the basic form of the standard license form utilized by ICARUS for IPE, reserving the right for HYPROTECH to amend as necessary to offer additional protections deemed important to HYPROTECH.
