Employer’s design. The Employer shall provide the Contractor with all information required to complete network designs e.g. required performance specifications, underlying transmission medium performance, hop distances, etc. The Employer shall verify and accept the network designs prior to implementation thereof. However, such inspection and acceptance of the designs shall not relieve the Contractor of their responsibility to meet all the network performance requirements, and it shall not prevent subsequent rejection of the design if it is found to perform below specification during commissioning and testing. For each task order and prior to installation, the Employer shall compile a site survey report providing details of the availability of site specific requirements for successful installations. However, the Employer may request the Contractor to perform this work. After the Contractor site visits and the site visit report has been issued to the Employer, the Employer shall provide any missing infrastructure and facilities not supplied with the equipment (e.g. DC supply) that are necessary for the completion of the site works as indicated in the Contractor’s site survey report. The Employer shall organise access to all sites for the Contractor as per the agreed programme.

Employer’s design. When and where specific reference is made or preference given to specified material, the Tenderer shall include such as his main offer in the tender. Should the Tenderer fail to comply with these requirements, this may lead to the disqualification of the tender submitted. An extension of Time for Completion of the Contract due to time spent on the alteration of the tender drawings to suit the Contractor’s alternative proposals or due to time spent in obtaining the principal agent’s approval of such alternatives, shall not be considered. Acceptance of an alternative proposal or offer shall not relieve the Contractor of any of his obligations in terms of the Contract. The Contractor’s cost of preparation and submission of an alternative proposal shall be deemed to be included in the rates tendered for the execution of the Work.

Procedure for submission and acceptance of Contractor’s design The Contractor’s design shall comply with all design requirements stated in Lethabo Solar PV Facility Employer’s Requirements (375-172742). A detailed design phase shall precede the construction phase of the Project during which the design drawings are submitted to the Employer for acceptance. Other requirements of the Contractor’s design The Contractor is mandated in terms of Construction Regulations 2014: Duties of Designer, 6(1) g to fulfil the duties described therein. Any risk associated with the Contractor’s design shall be highlighted to the Employer together with mitigation measures. These risks shall be included in the project risk register. All As-built drawings, operational manuals and maintenance schedules shall be provided to the Employer in adherence with the applicable requirements stated in the relevant section of the Lethabo Solar PV Facility Employer’s Requirements (375-172742). It is preferred that adequate Subcontractors and consulting Engineers be appointed for execution of the following scope: • Grid Connection Works as described in Lethabo Solar PV Facility Employer’s Requirements (375- 172742), section 16. • Physical Security as described in Lethabo Solar PV Facility Employer’s Requirements (375-172742), section 10.10. The Sub Contractor responsible for executing the Grid Connection Works shall be Eskom Approved. This is also applicable to the Grid Connection Works Consulting Engineer. The Sub Contractor responsible for executing the Physical security scope shall have a valid registration with PSiRA.
