Employees on lay off shall continue to accumulate seniority until the employee loses their seniority in accordance with Article 13.03(c).
Employees on lay off shall be recalled in the inverse order of lay-off, provided no intervening factors have occurred which essentially change the ability of the employee to perform the offered employment.
Employees on lay off will be given the opportunity to fill temporary positions/vacancies of greater than ten (10) consecutive working days. Employees will not be obligated to accept these positions. Employees on lay- off who are filling temporary positions/vacancies will not forfeit their recall rights to permanent work.

An employee who fails to respond to a job offer or return to a position which the employee has accepted as specified above, shall forfeit further recall rights unless such failure to contact the Employer was due to good cause. If an employee turns down three (3) comparable positions, they will lose their rights to recall, and seniority will be terminated.
Employees on lay off shall be recalled in the order of their seniority. Seniority may be by-passed for an employee where the employee does not have the required qualifications or ability to perform the available work. Seniority shall be a factor in employee requests for is defined as a permanent move one department to another within the bargaining unit resulting in no of classification or annual salary for the employee.
Employees on lay off shall be recalled in the order of their seniority within their classification or facility or former program within their District, provided they have the required knowledge, ability and qualifications to do the job.
