Common use of Employees Covered Clause in Contracts

Employees Covered. (a) Pursuant to and in accordance with all applicable provisions of the Ontario Labour Relations Act, as amended, Chrysler Canada Inc., herein called the Company does hereby recognize the Union as the exclusive representative for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment for the term of this Agreement of all employees of the Company included in the bargaining units described in Schedule "A". (b) This Agreement shall extend automatically to production and maintenance employees at any new plant the Company builds that the parties shall agree, or, in the absence of agreement, that the Ontario Labour Relations Board shall determine, constitutes an accretion to the multiple plant bargaining unit this Agreement covers, excluding such employees as the parties agree or the Board decides should be excluded. (c) If the Union becomes the representative of employees at a plant that is not a part of such unit, the parties shall determine by negotiation whether this Agreement shall apply, in whole or in part, to such employees. Bargaining Units referred to in Section (1.1) of the Production and Maintenance Agreement between Chrysler Canada Inc., and the National Automobile, Aerospace and Agricultural Implement Workers Union of Canada (CAW-Canada) and certain of its Local Unions dated September 24, 2012. 1. All hourly-rated employees of Chrysler Canada Inc. in its Windsor Assembly Plant, except timekeepers, time study employees, employees in a supervisory capacity, draftspersons, technical employees, office and salaried employees, security and fire officers and all employees covered by any other collective agreement with the Company. 2. All hourly-rated employees of Chrysler Canada Inc. in its Automotive Research and Development Centre, except employees in timekeeping, time study employees, employees in a supervisory capacity, and draftspersons. 3. All hourly-rated employees of Chrysler Canada Inc. in its Etobicoke Casting Plant except supervisors, employees in a supervisory capacity, office and salaried employees and all other employees covered by any other collective agreement with the Company. 4. All hourly-rated employees in its Brampton Assembly Plant, excluding supervisors, persons above the rank of assistant supervisors, security and fire officers, medical staff, timekeepers, general office employees, human resource department employees, clerical employees, plant engineers, designers and draftspersons, Industrial Engineers, technical and professional employees and their assistants, and all employees covered by any other collective agreement with the Company. If it is considered that the above descriptions differ from the original Ontario Labour Relations Board certification or the initial agreement between the parties describing the bargaining unit, the Board certification or the initial agreement shall govern. By agreeing to the foregoing descriptions, neither party hereto waives the right to move to amend or clarify any certification, by the Ontario Labour Relations Board. (c05).

Employees Covered. (b) This Agreement shall extend automatically to production and maintenance employees at any new plant the Company Corporation builds that the parties shall agree, or, in the absence of agreement, that the Ontario Labour Relations Board shall determine, constitutes an accretion to the multiple plant bargaining unit this Agreement covers, excluding such employees as the parties agree or the Board decides should be excluded. (c) If the Union becomes the representative of employees at a plant that is not a part of such unit, the parties shall determine by negotiation whether this Agreement shall apply, in whole or in part, to such employees. Bargaining Units referred to in Section (1.1) of the Production and Maintenance Agreement between Chrysler Canada Inc.Ltd., and the National Automobile, Aerospace and Agricultural Implement Workers Union of Canada (CAW-CAW- Canada) and certain of its Local Unions dated September 2415, 20121996. 1. All hourly-rated employees of Chrysler Canada Inc. Ltd. in its Windsor Assembly Plant, except timekeepers, time study employeesmen, employees in a supervisory capacity, draftspersonsdraftsmen, chemists, metallurgists, laboratory workers, technical employees, office and salaried employees, security and fire officers plant protection men and all employees covered by any other collective agreement with the CompanyCorporation. 2. All hourly-rated employees of Chrysler Canada Inc. Ltd. in its Grand Marais Road Building and Automotive Research and Development Centre, except employees in timekeepingtimekeepers, time study employeesmen, employees in a supervisory capacity, draftsmen, chemists, metallurgists, laboratory workers, technical employees, office and draftspersonssalaried employees, plant protection men and all employees covered by any other collective agreement with the Corporation. 3. All hourly-rated employees of Chrysler Canada Inc. Ltd. in its Etobicoke Casting Ajax Trim Plant except supervisorsengineering personnel, nurses, matrons, timekeepers, time study men, employees in a supervisory capacity, draftsmen, chemists, metallurgists, laboratory workers, technical employees, office and salaried employees and all other employees covered by any other collective agreement with the Company. 4. All hourly-rated employees in its Brampton Assembly Plant, excluding supervisors, persons above the rank of assistant supervisors, security and fire officers, medical staff, timekeepers, general office employees, human resource department employees, clerical employees, plant engineers, designers and draftspersons, Industrial Engineers, technical and professional employees and their assistants, protection men and all employees covered by any other collective agreement with the CompanyCorporation. 4. All employees of Chrysler Canada Ltd. at its Etobicoke Casting Plant save and except foremen, persons above the rank of ▇▇▇▇▇▇▇, office and sales staff and security guards. 5. All production and maintenance employees at the ▇▇▇▇▇▇▇▇ Road Truck Assembly Plant, excluding timekeepers, time study men, employees in a supervisory capacity, draftsmen, chemists, metallurgists, laboratory workers, technical employees, office and salaried employees, plant protection men and all employees covered by any other collective bargaining agreement with the Corporation. 6. All hourly-rated production and maintenance employees at the Bramalea Assembly Plant, excluding assistant foremen, persons above the rank of assistant ▇▇▇▇▇▇▇, security personnel, watchmen, first aid staff, chief inspectors and assistant chief inspectors, timekeepers, general office employees, personnel department employees, clerical employees, plant and designing engineers, metallurgists, chemists, designers, draftsmen, detailers and their assistants, time and motion study employees, technical and professional employees and their assistants. If it is considered that the above descriptions differ from the original Ontario Labour Relations Board certification or the initial agreement between the parties describing the bargaining unit, the Board certification or the initial agreement shall govern. By agreeing to the foregoing descriptions, neither party hereto waives the right to move to amend or clarify any certification, by the Ontario Labour Relations Board. (c05).

Employees Covered. (b) This Agreement shall extend automatically to production and maintenance employees at any new plant If the Company builds that a new facility and transfers to it a significant portion of work performed exclusively by employees covered by this Agreement, this Agreement shall automatically cover employees working in the same or similar classifications at the new facility if the parties shall agree, or, or in the absence of agreement, that if the Ontario Labour Relations Board board shall determine, that such facility or any part thereof constitutes an accretion to the multiple plant bargaining unit this Agreement covers, excluding such employees as the parties agree agree, or the Board decides decides, should be excluded. (c) If the Union becomes the representative of employees at a plant that is not a part of such unit, the parties shall determine by negotiation whether this Agreement shall apply, in whole or in part, to such employees. Bargaining Units referred to in Section (1.1) of the Production Office and Maintenance Clerical and Engineering Agreement between Chrysler Canada Inc., and the National Automobile, Aerospace Aerospace, Transportation and Agricultural Implement General Workers Union of Canada (CAW-Canada) and certain of its Local Unions dated September 24, 2012. 1. All hourly-rated office and clerical employees of Chrysler Canada Inc. in its offices in the City of Windsor Assembly Plantsave and except Supervisors and those above the rank of Supervisor. Private Secretaries to Supervisors and above, except timekeepersand employees employed within the following classifications: Management Trainee, time study employeesPhotographer Technician, employees in a supervisory capacityTax Analyst, draftspersonsE.D.P. Analyst, technical employeesE.D.P. Technician, office Systems Analyst, Marketing and salaried employeesDistribution Analyst, security and fire officers Program Planning Coordinator, Buyer, Coordinator of Vendor Tooling, Parts Marketing Specialist, Industrial Engine Technician, Parts Remanufacturing Development Technician, Staff Person — Sales Administration, Staff Person — Sales Operations, Staff Person-Production Control, Product Engineer, Confidential Clerk to Plant Management, Credit Manager, and all employees covered by any other collective agreement in the following divisions, departments or sections: Personnel Division, Plant Labour Relations Dept., Manufacturing Budget Dept., Salary Payroll and Benefits Dept., Systems and G. & A. Budget Dept., Profit Planning and Analysis Dept., Product Analysis Dept., Budget and Financial Analysis Section of the Parts Accounting Dept., General Ledgers Dept., Industrial Engineering Dept., Quality Engineering Dept., and the Manufacturing Engineering Dept., with the Companyexception of employees on the Engineering Detail classification. The foregoing description of the bargaining unit shall be construed to exclude from the bargaining unit all employees in the following departments except Clerks, Typists and Stenographers unless acting as Private Secretaries to Supervisors and above: Market Representation Dept., (including Dealer Development Dept., Dealer Enterprise Dept., Dealer Planning Dept., Business Management Dept.), Marketing Services Dept., (including Truck Sales Dept., Fleet Sales Dept., Service Engineering Section and Service Promotion Section of the Service Dept.), Banking and Credit Dept., and Advertising and Sales Promotion Dept. 2. All hourly-rated office and clerical employees of Chrysler Canada Inc, Etobicoke Casting Plant in the Township of Etobicoke, save and except supervisors, persons above the rank of supervisor, plant nurse, security guards, private secretary to the plant manager, secretary to the manager of industrial engineering, secretary to the plant comptroller, secretary to the personnel manager, budget clerk, and analyst — method and standards. All Tool Engineers "A" employed by Chrysler Canada Inc. at its Etobicoke Casting Plant, Etobicoke, Ontario. 3. All employees of Chrysler Canada Inc. in its Automotive Research office at Windsor employed in the following engineering and Development Centretechnical classifications: Tool Engineer "A", except employees in timekeepingSenior Tool Engineer, time study employeesPlant Engineer "A", employees in a supervisory capacitySenior Plant Engineer, Material Handling Engineer, Drafting Person — Tool and draftspersonsPlant Engineering, Tool Engineer "B", Tool and Die Designer "A", Trouble Person — Tool Engineering "B" and Trouble Person — Tool Engineering "A". 34. All hourly-rated employees of Chrysler Service Contract Company Inc. in Windsor, Ontario, save and except Supervisors, persons above the rank of Supervisor, Systems Development Analyst, Secretary to Manager of Operations and persons covered by subsisting collective agreements. 5. All office, clerical and engineering employees of Chrysler Canada Inc. in its Etobicoke Casting Plant Brampton, Ontario save and except supervisors, employees in a supervisory capacity, office and salaried employees and all other employees covered by any other collective agreement with the Company. 4. All hourly-rated employees in its Brampton Assembly Plant, excluding supervisors, persons above the rank of assistant supervisorssupervisor, security secretary to the Plant Manager, secretary to the Manufacturing Engineer Manager, secretary to the Production Control Manager, secretary to the Product Engineering and fire officersQuality Control Manager, medical staffmanagement trainee, timekeeperssupplier quality assurance engineers, general office employees, human resource department employees, clerical employeesstatistical process control engineers, plant environmental control administrator, manufacturing engineer control coordinator, network analysts, industrial engineers, designers and draftspersons, Industrial Engineers, technical and professional employees and their assistantsstamping shift control coordinators, and all employees covered by any other collective agreement with in the Companyfollowing departments: personnel, finance, factory information system, product engineering and quality control, distribution, manufacturing group accounting and plant engineering. If it is considered that the above descriptions differ from the original Ontario Labour Relations Board certification or the initial agreement Agreement between the parties describing concerning the bargaining unit, the Board certification or of the initial agreement Agreement shall govern. By agreeing to the foregoing descriptions, neither party hereto waives the right to move to amend or clarify any certification, certification by the Ontario Labour Relations Board. (c05).

All hourly-rated employees of Chrysler FCA Canada Inc. in its Automotive Research and Development Centre, except employees in timekeeping, time study employees, employees in a supervisory capacity, and draftspersons. 3. All hourly-rated employees of Chrysler FCA Canada Inc. in its Etobicoke Casting Plant except supervisors, employees in a supervisory capacity, office and salaried employees and all other employees covered by any other collective agreement with the Company. 4. All hourly-rated employees of Chrysler FCA Canada Inc. in its Automotive Research and Development Centre, except employees in timekeeping, time study employees, employees in a supervisory capacity, and draftspersons. 3. All hourly-rated employees of Chrysler FCA Canada Inc. in its Etobicoke Casting Plant except supervisors, employees in a supervisory capacity, office and salaried employees and all other employees covered by any other collective agreement with the Company. 4. All hourly-rated employees of Chrysler FCA Canada Inc. in its Automotive Research and Development Centre, except employees in timekeeping, time study employees, employees in a supervisory capacity, and draftspersons. 3. All hourly-rated employees of Chrysler FCA Canada Inc. in its Etobicoke Casting Plant except supervisors, employees in a supervisory capacity, office and salaried employees and all other employees covered by any other collective agreement with the Company. 4. All hourly-rated employees in its Brampton Assembly Plant, excluding supervisors, persons above the rank of assistant supervisors, supervisors security and fire officers, medical staff, timekeepers, general office employees, human resource department employees, clerical employees, plant engineers, designers and draftspersons, Industrial Engineers, technical and professional employees and their assistants, and all employees covered by any other collective agreement with the Company. If it is considered that the above descriptions differ from the original Ontario Labour Relations Board certification or the initial agreement between the parties describing the bargaining unit, the Board certification or the initial agreement shall govern. By agreeing to the foregoing descriptions, neither party hereto waives the right to move to amend or clarify any certification, by the Ontario Labour Relations Board. (c05, c16).

Employees Covered. RECOGNITION (a) Pursuant to and in accordance with all applicable provisions of the Ontario Labour Relations Act, as amended, Chrysler Canada Inc., herein called the Company Corporation does hereby recognize the Union as the exclusive representative for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment for the term of this Agreement of all employees of the Company Corporation included in the bargaining units described in Schedule "A". (b) . This Agreement shall extend automatically to production and maintenance employees at any new plant the Company builds Corporation that the parties shall agree, or, in the absence of agreement, that the Ontario Labour Relations Board shall determine, constitutes an accretion to the multiple plant bargaining unit this Agreement covers, excluding such employees as the parties agree or the Board decides should be excluded. All employees of Canada at its Casting Plant save and except foremen, persons above the rank of ▇▇▇▇▇▇▇, office and security guards. production and maintenance employees at the Road Truck Assembly Plant, excluding timekeepers, study men, employees in a supervisory capacity, draftsmen, chemists, metallurgists, laboratory workers, technical employees, office and salaried employees, plant protection men and all employees covered by any other collective bargaining agreement the Corporation. All production and maintenance employees at the Plant, excluding foremen, persons above the rank of ▇▇▇▇▇▇▇, security personnel, watchmen, staff, chief Inspectors and assistant inspectors, timekeepers, general office employees, personnel department employees, clerical employees, plant and designing engineers, metallurgists, chemists, designers, draftsmen, and their assistants, time and motion study employees, technical and professional employees and their assistants. All hourly-rated production and maintenance employees at the Brampton Assembly Plant, excluding assistant foremen, persons above the rank of assistant ▇▇▇▇▇▇▇, security personnel, watchmen, first aid staff, chief inspectors and assistant chief inspectors, timekeepers, general office employees, personnel department employees, clerical employees, plant and designing engineers, metallurgists, chemists, designers, draftsmen, detailers and their assistants, time and motion study employees, technical and professional employees and their assistants. If it is considered that the above descriptions differ from the original Ontario Labour Relations Board certification or the initial agreement between the parties describing the bargaining unit, the Board certification or the initial agreement shall govern. By agreeing to the foregoing descriptions, neither party hereto waives the right to move to amend or clarify any certification, by the Ontario Labour Relations Board. (c05).

(b) This If the Corporation builds a new facility and transfers to it a significant portion of work performed exclusively by employees covered by this Agreement, this Agreement shall extend automatically to production and maintenance cover employees working in the same or similar classifications at any the new plant the Company builds that facility if the parties shall agree, or, or in the absence of agreement, that if the Ontario Labour Relations Board board shall determine, that such facility or any part thereof constitutes an accretion to the multiple plant bargaining unit this Agreement covers, excluding such employees as the parties agree agree, or the Board decides decides, should be excluded. (c) If the Union becomes the representative of employees at a plant that is not a part of such unit, the parties shall determine by negotiation whether this Agreement shall apply, in whole or in part, to such employees. Technician, office Systems Analyst, Marketing and salaried employeesDistribution Analyst, security and fire officers Program Planning Coordinator, Buyer, Coordinator of Vendor Tooling, Parts Marketing Specialist, Industrial Engine Technician, Parts Remanufacturing Development Technician, Staff Person — Sales Administration, Staff Person — Sales Operations, Staff Person-Production Control, Product Engineer, Confidential Clerk to Plant Management, Credit Manager, and all employees covered by any other collective agreement in the following divisions, departments or sections: Personnel Division, Plant Labour Relations Dept., Manufacturing Budget Dept., Salary Payroll and Benefits Dept., Systems and G. & A. Budget Dept., Profit Planning and Analysis Dept., Product Analysis Dept., Budget and Financial Analysis Section of the Parts Accounting Dept., General Ledgers Dept., Industrial Engineering Dept., Quality Engineering Dept., and the Manufacturing Engineering Dept., with the Companyexception of employees on the Engineering Detail classification. The foregoing description of the bargaining unit shall be construed to exclude from the bargaining unit all employees in the following departments except Clerks, Typists and Stenographers unless acting as Private Secretaries to Supervisors and above: Market Representation Dept., (including Dealer Development Dept., Dealer Enterprise Dept., Dealer Planning Dept., Business Management Dept.), Marketing Services Dept., (including Truck Sales Dept., Fleet Sales Dept., Service Engineering Section and Service Promotion Section of the Service Dept.), Banking and Credit Dept., and Advertising and Sales Promotion Dept. 2. All hourly-rated employees in its Brampton Assembly Plant, excluding supervisors, persons above the rank of assistant supervisor, plant nurse, security guards, private secretary to the plant manager, secretary to the manager of industrial engineering, secretary to the plant comptroller, secretary to the personnel manager, budget clerk, and analyst — method and standards. All Tool Engineers "A" employed by DaimlerChrysler Canada Inc. at its Etobicoke Casting Plant, Etobicoke, Ontario. 3. All employees of DaimlerChrysler Canada Inc. in its office at Windsor employed in the following engineering and technical classifications: Tool Engineer "A", Senior Tool Engineer, Plant Engineer "A", Senior Plant Engineer, Material Handling Engineer, Drafting Person — Tool and Plant Engineering, Tool Engineer "B", Tool and Die Designer "A", Trouble Person — Tool Engineering "B" and Trouble Person — Tool Engineering "A". 4. All employees of DaimlerChrysler Service Contract Company Inc. in Windsor, Ontario, save and except Supervisors, persons above the rank of Supervisor, Systems Development Analyst, Secretary to Manager of Operations and persons covered by subsisting collective agreements. 5. All office, clerical and engineering employees of DaimlerChrysler Canada Inc. in Brampton, Ontario save and except supervisors, security persons above the rank of supervisor, secretary to the Plant Manager, secretary to the Manufacturing Engineer Manager, secretary to the Production Control Manager, secretary to the Product Engineering and fire officersQuality Control Manager, medical staffmanagement trainee, timekeeperssupplier quality assurance engineers, general office employees, human resource department employees, clerical employeesstatistical process control engineers, plant environmental control administrator, manufacturing engineer control coordinator, network analysts, industrial engineers, designers and draftspersons, Industrial Engineers, technical and professional employees and their assistantsstamping shift control coordinators, and all employees covered by any other collective agreement with in the Companyfollowing departments: personnel, finance, factory information system, product engineering and quality control, distribution, manufacturing group accounting and plant engineering. If it is considered that the above descriptions differ from the original Ontario Labour Relations Board certification or the initial agreement Agreement between the parties describing concerning the bargaining unit, the Board certification or of the initial agreement Agreement shall govern.
