Emergency Events. VDOC will use VRI at VDOC Correctional Facilities for medical emergencies, if an in-person Qualified Interpreter would have otherwise been the appropriate auxiliary aid or service for that inmate in that context. If remote interpreting services are not appropriate in the situation, VDOC personnel will work in conjunction with Medical staff to secure an in-person Qualified Interpreter or other auxiliary aids or services as soon as possible. Life-saving and other emergency medical care should never be delayed because qualified interpreter services are not available.

The ESS will operate per vendor configuration to provide backup services to the Site once the grid power is lost. MCE does not guarantee a set amount of discharge from the ESS, nor does it guarantee that the ESS will provide sufficient electricity to supply the Site’s load during the Emergency Event.
Emergency Events. In case of an emergency due to interference, failure of traffic light signal system, or other similar unforeseen events, Licensor may act to protect the public health and safety of its citizens, and to protect public and private property, notwithstanding any provision in this Agreement. In case of a network emergency, Licensee may access its Equipment without first obtaining any otherwise necessary permit(s) or authorization(s) provided Licensee has conducted network trouble-shooting and diagnostic tests and has reasonably identified the point or points of network failure or malfunction. Licensee shall conduct its activities within the Rights-of-Way in such a manner as to protect public and private property. Each Party will make every reasonable effort to coordinate its emergency response with the other Party.

Emergency Events. Township reserves the right to take all reasonable actions in the case of an emergency to protect the public health and safety of its citizens, and to ensure the safe operation of its rights of way and public facilities. The Parties will use reasonable efforts to coordinate any emergency responses. In case of an emergency affecting the Equipment or Licensee’s Use, Licensee may access the ROW and perform necessary repairs to its Equipment and to the pole, including the right to install a replacement pole, without first obtaining any otherwise necessary permit(s) or authorization(s). All emergency work in the ROW shall be conducted in a safe and good workmanlike manner and in accordance with the Law.

Emergency Events. After VRI is implemented pursuant to this Agreement, DPSCS will make best efforts to provide VRI at DPSCS Correctional Facilities for use in unscheduled medical emergencies. If remote interpreting services are not appropriate in the situation, DPSCS personnel will work in conjunction with Medical staff to attempt to secure an in-person Qualified Interpreter or other Auxiliary Aids or Services as soon as possible. Life saving and other emergency medical care should never be delayed because no interpretation services are available. For the following categories of Deaf inmates, VRI may not provide Effective Communication, and an in-person Qualified Interpreter or other Auxiliary Aids or Services may be the most appropriate auxiliary aid or interpretive service. In such circumstances, DPSCS shall make best efforts to provide an in-person Qualified Interpreter • Deaf inmates who have limited ability to move their heads, hands, or arms; vision problems; cognitive or consciousness issues; or pain issues; • Deaf inmates who must be moved to areas of the DPSCS Correctional Facility that do not have a designated high speed Internet line; and • Deaf inmates who will be treated in rooms where space considerations mitigate against using the service. • Deaf inmates who have psychiatric or mental health issues that complicate communications through VRI.
