Common use of Emergency Conditions Clause in Contracts

Emergency Conditions. If in the sole discretion of the Mayor it is determined that extreme civil emergency conditions exist, including, but not limited to, riots, civil disorders, tornado conditions, floods, financial emergency, or other similar catastrophes, the provisions of this Agreement may be temporarily suspended by the Mayor or the City Council during the time of the declared emergency conditions; provided that wages shall not be suspended nor shall this Section limit an employee's right to invoke the Grievance Procedure over the issue of pay.

If in the sole discretion of the City Manager or the Mayor it is determined that extreme civil emergency conditions exist or may exist, including, but not limited to, riots, civil disorders, tornado hurricane conditions, floods, financial emergencystrikes, or other similar catastrophescatastrophes or disorders, the provisions of this Agreement may be temporarily suspended by the Mayor City Manager or the City Council Mayor during the time of the declared emergency conditions; emergency, provided that wages wage rates and other direct monetary payments shall not be suspended nor shall suspended. Nothing in this Section limit an employee's right to invoke 7 shall effect the Grievance Procedure over the issue of payCity’s Management rights under Article 3, Section 4.

If in the sole discretion of the City Manager or Mayor it is determined that extreme civil emergency conditions exist, including, but not limited to, riots, civil disorders, tornado strikes, hurricane conditions, floods, financial emergency, or other similar catastrophescatastrophes or disorders, the provisions of this Agreement may be temporarily suspended by the City Manager or Mayor or the City Council during the time term of the declared emergency conditions; provided that wages wage rates and other direct monetary payments shall not be suspended nor shall this Section limit an employee's right to invoke the Grievance Procedure over the issue of paysuspended.
