Common use of Eligible Contract Participant Clause in Contracts

Eligible Contract Participant. It is an "eligible contract participant" as that term is defined in Section 1a(12) of the Commodity Exchange Act, as amended by the Commodity Futures Modernization Act of 2000, and it has entered into this Agreement and it is entering into the Transaction in connection with its line of business (including financial intermediation services) or the financing of its business; and the material terms of this Agreement and the Transaction have been individually tailored and negotiated.

Eligible Contract Participant. It is an "eligible contract participant" as that term is defined in Section 1a(12) of the Commodity Commodities Exchange Act, as amended by the Commodity Futures Modernization Act of 2000, and it has entered into this Agreement and it is entering into the Transaction in connection with its line of business (including financial intermediation services) or the financing of its business; and the material terms of this Agreement and the Transaction have been individually tailored and negotiatedamended.

Section 1a(12).

It is constitutes an "eligible contract participant" as that term is defined in within the meaning of Section 1a(12) of the U.S. Commodity Exchange Act, as amended by the Commodity Futures Modernization Act of 2000, and it has entered into amended; this Agreement and it each Transaction hereunder is entering into the Transaction in connection with its line of business (including financial intermediation services) or the financing of its businesssubject to individual negotiation by each party; and the material terms of and, neither this Agreement and nor any Transaction hereunder will be executed or traded on a "trading facility" within the Transaction have been individually tailored and negotiatedmeaning of Section 1a(33) of the U.S. Commodity Exchange Act, as amended.

It is an "eligible contract participant" as that term is defined in Section 1a(12) of the Commodity Exchange Act, as amended by the Commodity Futures Modernization Act of 2000, and it has entered into this Agreement and it is entering into the Transaction in connection with its line of business (including financial intermediation services) or the financing of its business; and the material terms of this Agreement and the Transaction have been individually tailored and negotiated.it

Eligible Contract Participant. (a) It is an "eligible contract participant" as that term is defined in Section 1a(12) of the Commodity Exchange Act, as amended by the Commodity Futures Modernization Act of 2000, (b) the Agreement and it has entered into each Transaction is subject to individual negotiation by each party and (c) neither this Agreement and it is entering into nor any Transaction will be executed or traded on a "trading facility" within the Transaction in connection with its line meaning of business (including financial intermediation servicesSection 1a(33) or of the financing of its business; and the material terms of this Agreement and the Transaction have been individually tailored and negotiatedCommodity Exchange Act, as amended.
