Common use of Electric Metering Device Clause in Contracts

Electric Metering Device. The Facility Energy made available to Buyer or Buyer’s Agent by Seller under this Agreement shall be measured using one (1) Electric Metering Device installed, owned and maintained by Buyer. Buyer or its designee, at no expense to Seller, shall inspect and test all Electric Metering Devices as required. Seller or its designee, at no expense to Buyer, shall provide a dedicated analog telephone service solely for the purpose of delivering data from the Electric Metering Device, if required, as determined by LADWP. If an Electric Metering Device fails to register, or if the measurement made by an Electric Metering Device is found upon testing to be inaccurate by more than one percent (1.0%), an adjustment shall be made correcting all measurements by the inaccurate or defective Electric Metering Device for both the amount of the inaccuracy and the period of the inaccuracy. The adjustment period shall be determined as far as can be reasonably ascertained by Xxxxx from the best available data. If the period of the inaccuracy cannot be ascertained reasonably, any such adjustment shall be for a period equal to one-third of the time elapsed since the preceding test of the Electric Metering Devices. To the extent that the adjustment period covers a period of deliveries for which payment has already been made by Buyer, Buyer shall use the corrected measurements as determined in accordance with this Section
