The 'Effect on Appointed Positions' clause defines what happens to any roles or positions that a party holds by virtue of the agreement, such as directorships or committee memberships, when the agreement ends or is otherwise affected. Effect on Appointed Positions. Employees who hold a rank within the classified service but are serving in an appointed position within the Department cannot be displaced (bumped) within the meaning of this Article by other bargaining unit employees during the time such employees hold their appointed positions. In the event such a person is removed from his/her appointed position he/she shall have the right to return to his/her last-held civil service rank.
Effect on Appointed Positions. Employees who hold a rank within the classified service but are serving in an unclassified or appointed position within the City cannot be displaced (bumped) within the meaning of this Article by other bargaining unit employees during the time such employees hold their appointed positions. Subject to the provisions of Section 12.05, in the event such a person is removed (un-appointed) from their appointed position they shall have the right to return to their last-held civil service rank. The return of such person shall not result in the removal (bumping) of another person in such rank. To the extent such removal causes there to be an excess above the authorized strength at such rank, the excess shall be reduced through attrition. Notwithstanding the foregoing, if a Commander is removed by reason of the elimination of a Commander position(s) as part of a department-wide reduction in staffing that includes a reduction in the number of personnel in the ranks of Lieutenant, Sergeant and/or Police Officer due to budgetary reasons, the “attrition” requirement of the preceding sentence shall not apply.
