Educational Support Personnel. 8.1.2.1 A seniority list shall be developed for ESP members. Seniority shall be determined by the date on which a full or part time ESP is officially hired by the District. Each ESP will be listed on the classified seniority list in the order of his/her hire date within a Subgroup. If an ESP leaves a Bargaining Unit position for another position in a different Subgroup in the District, the seniority date of the original ESP position(s) shall be retained on the classified seniority list for a period of one (1) year.

Educational Support Personnel. An ESP may apply for a leave of absence for personal reasons. Requests for personal leave must be submitted at least forty-five (45) days prior to the date when the leave is to begin. At least fifteen (15) days before the requested effective date of the leave, the Superintendent will make a recommendation to the Board in accordance with the best interests of the District as far as programs, students, and staff are concerned. Nothing in this Section is in derogation of and does not waive any rights Staff Members may have to leave rights provided for by the Americans with Disabilities Act, the ADAAA of 2008, FMLA, USERRA and other similar laws.

Educational Support Personnel. The Superintendent and the NTA recognize that a teacher's primary responsibility is to teach and that their energy should, to the extent possible, be utilized to this end. The Superintendent and the NTA recognize that support personnel are desirable as a means of relieving the teacher of clerical and other non-teaching activities.

If placement on a new step results in less than their current figure they will continue to receive their current longevity payment until they reach a step which pays them more.
