Early Construction of Base Case Facilities. Developer may request Connecting Transmission Owner to construct, and Connecting Transmission Owner shall construct, subject to a binding cost allocation agreement reached in accordance with Attachment S to the ISO OATT, including Section 25.8.7 thereof, using Reasonable Efforts to accommodate Developer’s In-Service Date, all or any portion of any System Upgrade Facilities or System Deliverability Upgrades required for Developer to be interconnected to the New York State Transmission System which are included in the Base Case of the Class Year Study for the Developer, and which also are required to be constructed for another Developer, but where such construction is not scheduled to be completed in time to achieve Developer’s In-Service Date.

Early Construction of Base Case Facilities. The Interconnection Customer may request the Participating TO to construct, and the Participating TO shall construct, using Reasonable Efforts to accommodate Interconnection Customer's In-Service Date, all or any portion of any Network Upgrades required for Interconnection Customer to be interconnected to the Participating TO’s Transmission System which are included in the Base Case of the Interconnection Studies for the Interconnection Customer, and which also are required to be constructed for another interconnection customer, but where such construction is not scheduled to be completed in time to achieve Interconnection Customer's In-Service Date.
Early Construction of Base Case Facilities. (Includes facilities required for all queued projects with interconnection agreements ).Interconnection Customer may request Transmission Owner to construct, and Transmission Owner shall construct, using Reasonable Efforts to accommodate Interconnection Customer’s In-Service Date, all or any portion of any Network Upgrades, Transmission Owner’s System Protection Facilities or Distribution Upgrades required for Interconnection Customer to be interconnected to the Transmission or Distribution System, as applicable, which are included in the Base Case of the Interconnection Facilities Study for Interconnection Customer, and which also are required to be constructed for another Interconnection Customer with a prior GIA, but where such construction is not scheduled to be completed in time to achieve Interconnection Customer’s In-Service Date. Any such Network Upgrades, System Protection Facilities or Distribution Upgrades are included in the facilities to be constructed and as set forth in Appendix A to this GIA to the extent they are reasonably known.

Early Construction of Base Case Facilities. In accordance with Section 12.2.2 of Transmission Provider’s GIP, Interconnection Customer may request Transmission Provider to construct all or any portion of any Network Upgrades required for Interconnection Customer to be interconnected to the Transmission System which are included in the Base Case of the Facilities Study for Interconnection Customer, and which also are required to be constructed for another Interconnection Customer, but where such construction is not scheduled to be completed in time to achieve Interconnection Customer's In-Service Date. In accordance with Section 12.2.3 of Transmission Provider’s GIP, Interconnection Customer also may request that Transmission Provider advance the construction of all or any portion of any Network Upgrades that are part of Transmission Provider’s most recent transmission planning assessment study, performed to comply with Applicable Reliability Standards, but would not otherwise be completed in time to support the Interconnection Customer’s In-Service Date. Provided that Interconnection Customer pays the costs for constructing such Network Upgrades, Transmission Provider shall use Reasonable Efforts to construct those Network Upgrades in accordance with Interconnection Customer's In-Service Date. Interconnection Customer shall be entitled to transmission rate credits for costs paid by Interconnection Customer to Transmission Provider for the construction of these Network Upgrades, including but not limited to the costs it paid to expedite construction, in accordance with Article 11.5 of this GIA.
