Early Commencement. The Commencement Date, Rent and Tenant’s other obligations shall be advanced to such earlier date as: (i) Landlord substantially completes any improvements to the Premises required under this Lease to an extent that Tenant is able to occupy the Premises, and Landlord delivers possession thereof, provided that Landlord has provided Tenant access to the Premises pursuant to the terms and conditions of Section 4.5 of the Work Letter Agreement, or (ii) Tenant, with Landlord’s written permission, otherwise commences occupying the Premises for the operation of its business therein (and not pursuant to Section 4.5 of the Work Letter Agreement). During any period that Tenant shall be permitted to enter the Premises prior to the Commencement Date other than to occupy the same (e.g., to perform alterations or improvements), Tenant shall comply with all terms and provisions of this Lease, except those provisions requiring the payment of Base Rent. Landlord shall permit early entry, pursuant to the terms and conditions of Section 4.5 of the Work Letter Agreement, so long as Tenant is in compliance with the other provisions of this Lease, including the insurance requirements under Article 10.

Early Commencement. If Sublessee occupies the Premises prior to November 1, 1997, such occupancy shall be subject to all provisions of this Sublease, such occupancy shall not advance the Termination Date and Sublessee shall pay rent for such period at the initial monthly rates set forth below.

If such event occurs with respect to a portion of the Premises, the Commencement Date, Rent and Tenant’s other obligations shall be so advanced with respect to such portion (and fairly prorated based on the rentable square footage involved). During any period that Tenant shall be permitted to enter the Premises prior to the Commencement Date other than to occupy the same for business purposes (e.g., to perform alterations or improvements), Tenant shall comply with all terms and provisions of this Lease, except those provisions requiring the payment of Rent. Landlord shall permit early entry at least one (I) week prior to the Commencement Date, so long as the Premises are legally available, Landlord has completed any work required to be performed by Landlord under this Lease (or can reasonably accommodate the scheduling of minor work that Tenant desires to perform, such as cabling, without delaying any such Landlord work), and Tenant is in compliance with the other provisions of the Lease.
Early Commencement. If the Contracted Services started before the date of this Agreement, then the Term will be taken to have started from that earlier date and all dealings between the parties as from that earlier date relating to the provision of the Contracted Services will be taken to have been carried out on the terms of this Agreement. Waiver of rights of recovery from the Crown The Consultant waives all present and future rights to claim against the Crown for: personal injury to, or death of, the Consultant; either or both loss of, or damage to any of the Consultant’s property; and financial loss to the Consultant; arising from, or attributable to, the Consultant carrying out the Contracted Services. This waiver does not operate to release the Crown from any liability arising from, or attributable to, a wrongful (including negligent) act or omission of the Crown.

Early Commencement. Landlord shall deliver possession of the Premises to Tenant, pursuant to the Lease on the fifteenth day after Substantial Completion. However, Tenant may accept possession of the Premises upon Landlord’s receipt of a Temporary Certificate of Occupancy or upon Substantial Completion (prior to the Scheduled Completion Date) subject to the terms of the Lease. However, Tenant shall have no obligation to accept possession of the Premises or commence payment of rent until the later of (i) the Substantial Completion Date, or (ii) the Scheduled Completion Date of the Work as specified in the Project Schedule.
Early Commencement. If the annual benefit commences before the social security retirement age, the maximum permissible benefit may not exceed the lesser of the actuarial equivalent of a Ninety Thousand Dollar ($90,000) annual benefit beginning at the social security retirement age or the Participant's highest average compensation. If the annual benefit commences before the social security retirement age but after age sixty-two (62) years, this actuarial equivalent shall be the Ninety Thousand Dollar ($90,000) annual benefit reduced in accordance with reductions in social security benefits (i.e., 5/9% for each of the first 36 months and 5/12% for each additional month by which the commencement date precedes the social security retirement age). If the annual benefit commences before age sixty-two (62) years, this actuarial equivalent shall be the actuarial equivalent of the maximum permissible benefit as reduced under the prior sentence to age sixty-two (62) years. This actuarial equivalent (i.e., the pre-age 62 years actuarial equivalent) shall be the lesser of (A) the equivalent amount computed using the interest rate and mortality table (or tabular factor) specified in the defined benefit plan for determining the amount of the early retirement benefit that is payable under the plan, or (B) the equivalent amount computed using five percent (5%) interest and the applicable mortality table as prescribed by the Secretary of the Treasury for these purposes.
Early Commencement. Notwithstanding the Commencement Date, the Term shall commence earlier than the Commencement Date if Tenant occupies the Premises prior to the stated Commencement Date. "Occupancy", "occupy" or "occupies" as used in this lease shall mean use of the Premises for any reason by Tenant or Tenant's agents, licensees, employees, directors, officers, partners, trustees, and invitees (collectively, "Tenant's Agents").
