Duty to Proceed. Upon receipt of the Owner's Notice of Acceptance of the proposed Component Change Order, the Design-Builder shall, in accordance with Article 2.1.2 of this Contract, furnish Owner with items required thereunder and, upon the issuance of a Proceed Order, the Design-Builder shall within a reasonable time thereafter proceed with the performance of the Work covered by the Component Change Order.
Duty to Proceed. Following receipt of the Owner's Notice of Acceptance of the GMP Change Order, the Design-Builder shall furnish the items required by this Article 2.1.2 that are not yet submitted, and upon the issuance of a Proceed Order, the Design-Builder shall promptly thereafter begin or continue the prosecution of the Work in accordance with the Contract Documents and in accordance with any subsequent Construction Document Change Order.

Duty to Proceed. Except as expressly authorized in writing by Xxxxx, no failure of Xxxxx and Seller to reach agreement with respect to any dispute relating to or arising under this Order shall excuse Seller from proceeding diligently with the performance of the work required by this Order.
Duty to Proceed. No dispute under the Contract Documents, including those relating to the entitlement, cost, or time associated with a contemplated change or Design-Builder request for equitable adjustment under Section 8.6, shall interfere with the progress of the Work and Owner shall continue to satisfy its payment obligations to Design-Builder pending the final resolution of any dispute or disagreement. Design-Builder shall have the duty diligently to proceed with the Work in accordance with Owner’s instructions despite any dispute or claim, including those events where the Parties are in disagreement as to whether instructions from Owner constitute a valid claim or change to the Contract Documents and justify adjustments to the Contract Sum or Guaranteed Completion Date(s). Design- Builder’s sole recourse in the event of a dispute will be to pursue its rights under Article 11.

Duty to Proceed. Upon receipt of the Board’s Notice of Acceptance of the GMP Change Order and Proceed Order, the CMR shall promptly begin or continue the prosecution of the Work in accordance with the Contract Documents, but in any event, performance of the Work covered by the GMP Change Order shall commence no later than ten (10) days after the Proceed Order Date. The Proceed Order Date shall be the starting Date for the Work covered by the GMP change Order.
