Common use of Due to Disability Clause in Contracts

Due to Disability. The Company may terminate Executive’s employment if he/she becomes “disabled”, as defined below, upon written notice to Executive. For purposes of this Agreement, the term “Disability” shall mean a physical or mental incapacity as a result of which Executive becomes unable to continue to perform the essential functions of the job with or without accommodation hereunder for six consecutive calendar months or for shorter periods aggregating 180 business days in any 12 month period, or, if this provision is inconsistent with any applicable law, to the extent not prohibited by law.

Due to Disability. The Company may terminate Executive’s employment if he/she he becomes “disabled”, as defined below, upon thirty days’ written notice to Executive. For purposes of this Agreement, the term “Disability” shall mean a physical or mental incapacity as a result of which Executive becomes unable to continue to perform the essential functions of the his job with or without accommodation hereunder for six consecutive calendar months or for shorter periods aggregating 180 125 business days in any 12 twelve month period, or, if this provision is inconsistent with any applicable law, to the extent not prohibited by law.

For purposes of this Agreement, the term “Disability” shall mean a physical or mental incapacity as a result of which Executive becomes unable to continue to perform the essential functions of the his job with or without accommodation hereunder for six three (3) consecutive calendar months or for shorter periods aggregating 180 sixty (60) business days in any 12 twelve month period, or, if this provision is inconsistent with any applicable law, to the extent not prohibited by law.
