All records pertaining to department-required drug tests shall remain confidential, and shall not be provided to other employers or agencies without the written permission of the person whose records are sought. However, medical, administrative, and immediate supervisory personnel may have access to relevant portions of the records as necessary to insure the acceptable performance of the officer's job duties.

Drug Test Results. Client certifies that it understands that various states impose requirements and/or restrictions on employers intending to obtain or use drug testing results.For example, Minnesota only allows employers to conduct drug testing in certain situations and further requires that certain notices be provided.Client certifies that it will comply with any and all legal requirements or restrictions pertaining to its acquisition or use of drug test results received fromSapphire Check.
Drug Test Results. Laboratory personnel will advise the Human Resources Director, or his/her designee directly of all negative drug test results. The Human Resources Director will promptly advise the appropriate Department Head of these test results. The laboratory will advise only the MRO of any positive drug test results. The MRO must examine alternate medical explanations for any positive test results. This process shall include an interview with the affected employee and a review of the incident file, employee’s medical history and any other relevant biomedical factors. The MRO must review all medical records made available by the tested employee when a confirmed positive test could have resulted from legally prescribed medication. Employees involved in this step of the examination shall make themselves and any relevant records they wish to present available to the MRO within 48 hours after request. After reviewing the incident file and interviewing the employee, the MRO shall report to the City’s Human Resources Director or his/her designee the name of the employee, and whether a positive test of a prohibited substance has been verified. The Human Resources Director shall promptly notify the appropriate Department Head of the test result.

Drug Test Results. If the test results are positive and the employee has not offered an explanation to the M.R.O. sufficient to cause the M.R.O. to consider the results negative, the Director of Human Resources, or the Director’s designee, shall be notified and the Director, or his designee, shall in turn contact the employee. The employee must then decide whether or not the employee wants the sample within the second container stored at the initial collection site to be tested. If the employee so requests, then the sample within the second container shall be tested by the Employer using a second certified laboratory, subject to the testing procedure set forth in Section 16.9 of this Article. If the employee does not request the testing of the sample within the second container after the sample within the first container tests positive or if the employee requests the testing of the sample within the second container and it is also tests positive for an illegal drug, rehabilitative or disciplinary action shall be taken. Should the results be a “dilute negative”, the employee shall be required to repeat the testing procedure within 24 hours; the result of the second test shall then become the test of record. Should the candidate decline to repeat the testing procedure because of a “dilute negative” result on the first test, such shall constitute a “refusal to submit to testing”, which shall result in appropriate disciplinary action. Should the results of the second test be “dilute negative”, the candidate shall be deemed to have successfully completed the testing process. Should a “dilute positive” result be received by the City on the first or second test, such shall be considered as a “verified positive test”, which shall result in appropriate disciplinary action.
