Dockage. Tenant hereby acknowledges that the premises they have reserved includes a seawall/boat dockage and the undersigned agrees and acknowledges that the xxxxxx can be a dangerous area, that the seawall can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Xxxxxx accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the seawall/boat dockage. The total length of docked vessels shall not exceed the width of the property at the waterline. Docked vessels may not be rafted together so as to align two (2) or more vessels abeam of one another. No docked vessels may create a hazard to navigation. A hazard to navigation shall mean that the dock and vessel measures in excess of 25 percent of the width of the water body adjacent to the property. No boat docked at the premises shall be chartered to a person other than registered guests of the premises or used for live-aboards, sleeping or overnight accomodations. POOL & PATIO Tenant hereby acknowledges that the premises they have reserved includes a private pool and hot tub and the undersigned agrees and acknowledges that the pool, hot tub and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the pool, hot tub and patio areas. Refunds will not be made for maintenance issues including, but not limited to heating and air conditioning, appliances, televisions, and stereos. Notwithstanding the Port Passenger Charge which includes dockage, CRUISES shall pay dockage at the rate under the Tariff of the District for a laid-up CRUISES vessel based upon LOA (not GRT), for any day on which CRUISES sailing schedule indicates that CRUISES vessel is not to be at the Port of Palm Beach for any portion of the applicable 24-hour period, but on which day a CRUISES’ vessel is, in fact, at the Port of Palm Beach. Only the Board of Commissioners of the Port of Palm beach District shall have authority to waive or reduce such charges, but CRUISES shall be responsible for obtaining such waiver or reduction in writing on each case by case basis. In the event that, after Commencement of Sailings, CRUISES is not sailing in accordance with its then most recent sailing schedule approved by DISTRICT, and as a result, CRUISES (i) misses 2 consecutive scheduled sailings or (ii) misses six scheduled sailings in a 12 consecutive month period, then CRUISES shall, for such additional days of CRUISES being in port, pay dockage at the rate under the Tariff of the District for laid-up based upon LOA (not GRT) for any portion of a 24-hour period on which day CRUISES' vessel is, in fact, at the Port of Palm Beach. In the sole discretion of the Executive Director, relief from such charges already accrued, may be given, but must be in writing.
