Common use of Dissemination of Information Clause in Contracts

Dissemination of Information. The Borrower authorizes each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law (each a "Transferee") and any prospective Transferee any and all information in such Lender's possession concerning the creditworthiness of the Borrower and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees to be bound by Section 9.11 of this Agreement.

Dissemination of Information. The Borrower authorizes and the Company authorize each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower Borrower, the Company and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees in writing to be bound by Section 9.11 10.11 of this Agreement.

Dissemination of Information. The Borrower authorizes each Lender to disclose to any Participant or Purchaser Eligible Assignee or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees subject to be bound by Section 9.11 of this Agreement.

The Borrower authorizes each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower and its Subsidiaries, including without limitation any information contained in any ReportsAnnual Report on Form 10-K or any Quarterly Report on Form 10-Q; provided that each Transferee and prospective Transferee agrees to be bound by Section 9.11 of this Agreement.

The Borrower authorizes each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law and any actual party to any swap, derivative or other transaction under which payments are to be made by reference to the Borrower and its obligations, this Agreement or payments hereunder (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees to be bound by Section 9.11 of this Agreement.

The Borrower authorizes each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prior to any such disclosure, such prospective Transferee agrees shall agree to be bound by preserve in accordance with Section 9.11 13.04 the confidentiality of this Agreementany confidential information described therein.

The Borrower authorizes each Lender to disclose to any Participant or Purchaser assignee or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees subject to be bound by Section 9.11 of this Agreement12.6.

Dissemination of Information. The Each of the Parent and the Borrower authorizes each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Parent, the Borrower and its the Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees to be bound by Section 9.11 of this Agreement.

Dissemination of Information. The Each Borrower authorizes each Lender to disclose to any Participant assignee or Purchaser Participant, or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower Company and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees to be bound by Section 9.11 of this Agreement.

The Borrower authorizes each Lender to disclose to any Participant or Purchaser assignee or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ▇▇▇▇▇▇’s possession concerning the creditworthiness of the Borrower, the Borrower and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees in writing to be bound by Section 9.11 10.11 of this Agreement.

The Borrower authorizes and the Guarantor authorize each Lender to disclose to the Arranger and to any Participant or Purchaser Purchaser, or any other Person acquiring an interest in the Loan Documents by operation of law (each a "Transferee") and any prospective Transferee any and all information in such Lender's possession concerning the creditworthiness of the Borrower Borrower, the Guarantor and its their Subsidiaries, including without limitation provided that such Transferees agree to maintain the confidentiality of any information contained that is confidential in any Reports; provided that each Transferee and prospective Transferee agrees to be bound by the manner set forth in Section 9.11 of this Agreement10.14.

Dissemination of Information. The Borrower authorizes each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law (each a "Transferee") and any prospective Transferee any and all information in such Lender's possession concerning the creditworthiness of the Borrower and its SubsidiariesBorrower, including without limitation any information contained in any Reports; provided that each Transferee and prior to any such disclosure, such prospective Transferee agrees shall agree to be bound by preserve in accordance with Section 9.11 14.4 the confidentiality of this Agreementany confidential information described therein.

The Each Borrower authorizes each Lender to disclose to any Participant or Purchaser or any other Person acquiring an interest in the Loan Credit Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower Borrowers and its their respective Subsidiaries, including without limitation any information contained in any Reports; provided that each so long as such Transferee and or prospective Transferee agrees in writing to be bound by Section 9.11 of this Agreementkeep such information confidential.

The Borrower authorizes each Lender to disclose to any Assignee, any Participant or Purchaser or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Parent, Borrower and its Borrower’s Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees to be bound by Section 9.11 9.10 of this Agreement.

The Borrower authorizes each Lender to disclose to any Participant or Purchaser Eligible Assignee or any other Person acquiring an interest in the Loan Documents by operation of law (each a "“Transferee"”) and any prospective Transferee any and all information in such Lender's ’s possession concerning the creditworthiness of the Borrower and its Subsidiaries, including without limitation any information contained in any Reports; provided that each Transferee and prospective Transferee agrees to be bound by Section 9.11 of this Agreement.
