Dispossession. (1) Contracting Party shall take any measures of expropriation, nationalization or any other measures having effect equivalent to expropriation against nationalisation of investments or investors of the other contracting party except for reasons of public interest and provided that such measures are subject to payment of prompt and adequate compensation, they are not discriminatory and are in accordance with the national laws of general application. the legality of any such expropriation and the amount of compensation may, at the request of the investor, be subject to review in accordance with the legal requirements.
Dispossession. 5. 1. the contracting Parties do not take measures of expropriation or nationalization or any other measures the effect of which is, directly or indirectly dispossessing measures (hereinafter "dispossession measures"), nationals or companies of the other contracting party of their investments in its territory and in the maritime zones si-ce is not in the public interest and provided that such measures are not discriminatory or contrary to any specific commitment. The dispossession measures that might be taken shall be subject to the payment of prompt and adequate compensation in the amount calculated on the real value of the investment concerned must be assessed in relation to a normal economic situation, prior to any threat of dispossession, and, in particular, before dispossession is known to the public. Such compensation, its amount and has no later than the date of dispossession. the compensation shall be paid without delay, and effectively realisable freely transferable. it produces until the date of payment shall include interest at the rate agreed upon by the contracting parties.
Dispossession. (a) At any time permissible pursuant to the terms of the Lease Documents, the Landlord may exercise any rights and remedies under the Lease Documents, including to the effect of consummating any actual or constructive dispossession of any Tenant from any Facility (any such dispossession as to such Facility, a “Dispossession”) and seeking a new tenant, and in respect of the Landlord Exclusive Assets.
Dispossession. (1) Neither Contracting Party shall take any measures depriving, directly or indirectly, an investor of the other Contracting Party of an investment unless the following conditions are complied with :
Dispossession. The provisions of this Section 17 shall automatically operate as a notice to quit (any notice to quit, or of Landlord’s intention to re-enter, being hereby expressly waived), and Landlord may proceed to recover possession under and by virtue of the Laws of the Commonwealth of Pennsylvania or by such other proceedings, including re-entry and possession, as may be applicable.
Dispossession. The provisions of this Section 18 shall automatically operate as a notice to quit (any notice to quit being hereby expressly waived), and Landlord may proceed to recover possession under and by virtue of the laws of the jurisdiction where the Premises are located by legal process after twenty (20) days written notice.
Dispossession. In the event Subject Trackage Owner shall be involuntarily dispossessed, including threat of condemnation by competent Governmental Authority, of the right to operate upon and maintain any portion of the Subject Trackage, and provided Subject Trackage Owner shall by such involuntary dispossession lose the right to operate its own Trains on the Subject Trackage, Subject Trackage Owner shall have no obligation hereunder to provide such tracks of which Subject Trackage Owner has been dispossessed for Subject Trackage User’s use, and Subject Trackage User shall have and shall make no claim of any kind, legal or otherwise, against Subject Trackage Owner for failure to provide such tracks for Subject Trackage User’s use.

The provisions of this Section 16 shall automatically operate as a notice to quit (any notice to quit, or of Landlord's intention to re-enter, being hereby expressly waived), and Landlord may proceed to recover possession under and by virtue of the laws of the jurisdiction where the Premises are located.
Dispossession. 1. The investments made by nationals or companies of one Contracting Party shall enjoy full and complete protection and safety on the territory and in the maritime area of the other Contracting Party.
Dispossession. If Lessee is lawfully deprived of the possession of all or any part of the Premises by a party other than Lessor, Lessor may, upon receipt of notice from Lessee setting forth the circumstances, either install Lessee in possession of the Premises or terminate this Lease and refund to Lessee the pro rata amount of any prepaid but unearned Base Rent after receipt of such notice. Lessor shall not be liable to Lessee for any loss, damage or claim resulting from such deprivation of possession.
