Common use of Disposal Facilities Clause in Contracts

Disposal Facilities. Except as set forth on Schedule 4.19(d) (Disposal Facilities), none of the Borrower or any of its Material Subsidiaries is a treatment, storage or disposal facility requiring a Permit under the Resource Conservation and Recovery Act, 42 U.S.C.(S) 6901 et seq., as amended, the regulations thereunder or similar Requirement of Law.

Disposal Facilities. Except as set forth on Schedule 4.19(d) (Disposal Facilities)4.19, from and after the Petition Date none of the Borrower or any of its Material Subsidiaries is maintains a treatment, storage or disposal facility requiring a Permit under the Resource Conservation and Recovery Act, 42 U.S.C.(S) X.X.X.xx. 6901 et seq., as amended, the regulations thereunder or similar Requirement of Law.

Except as set forth on Schedule 4.19(d) 4.22 (Disposal Facilities), none of the Borrower or any of its Material Subsidiaries is maintains a treatment, storage or disposal facility requiring a Permit under the Resource Conservation and Recovery Act, 42 U.S.C.(S) 6901 U.S.C.ss.6901 et seq., as amended, the regulations thereunder or similar Requirement of Law.
