Common use of Discrimination Defined Clause in Contracts

Discrimination Defined. With reference to the British Columbia Human Rights Code, the Company and the Union agree that discrimination including harassment of any employee because of race, colour, ancestry, place of origin, political belief, religion, marital status, family status, physical or mental disability, sex, sexual orientation or age of that person or because that person has been convicted of a criminal or summary conviction offence that is unrelated to the employment or intended employment of that person is absolutely prohibited. Every employee has the right to work in an environment of mutual respect, free from discrimination and harassment including sexual harassment. Harassment includes but is not limited to any demeaning and abusive behaviour including intimidation and bullying. Any action contravening this policy will constitute grounds for discipline up to and including discharge, depending on the severity of the incident.
