Discretion and Control. Provider shall determine based upon its experience, skill and expertise the manner, methods or means to be utilized in performing Services. AYSO is only interested in the accomplishment of the end result sought and is not interested in, and does not have any right to control, the manner, methods or means of Provider’s delivery of the Services.

Discretion and Control. CORNERSTONE shall be regarded, designated and considered to be the employer with respect to all individuals whom CORNERSTONE may select, employ and assign to provide Services under this Agreement. CORNERSTONE shall be exclusively and solely responsible for selecting, compensating, hiring, retaining, evaluating, disciplining, dismissing and otherwise regulating the employment conditions, employment rights, compensation and other similar matters relative to all individuals whom CORNERSTONE employs in connection with providing Services under this Agreement. To the extent that CORNERSTONE may subcontract any or all aspects of the Services it agrees to provide to the Academy under this Agreement, CORNERSTONE represents that it shall include in any subcontracted services agreement provisions comparable to those contained in this Article I to identify the employer of any person providing services under a contracted services agreement or, in the absence of an employer and in the case of an independent contractor, to expressly provide that the service provider is an independent contractor, and is not intended to be, and shall not be regarded as, an employee of the Academy.
Discretion and Control. With respect to any sub-grantee(s) or contractor(s) that are entities, Grantee will retain complete discretion and control over, and shall act completely independently of the Foundation with respect to, their selection; The Foundation and Grantee acknowledge that the Foundation has not earmarked grant funds to any such sub-grantee or contractor, and there is no agreement, written or oral, by which the Foundation may cause Grantee to choose any such sub-grantee or contractor. With respect to any sub-grantee(s) or contractor(s) that are individuals, Grantee shall control the process of their selection and the parties acknowledge and agree that the project shall be undertaken under Xxxxxxx’s supervision.
Discretion and Control. Notwithstanding anything else set forth herein, Recipient shall have full discretion and control over the direction of the Legal Action without interference or input by OVDF. OVDF is not a party to the Legal Action, and Recipient shall not represent to any third party that OVDF is a party to the Legal Action.
