Common use of Discharge Clause in Contracts

Discharge. The Debenture Trustee shall at the written request of the Trust release and discharge this Indenture and execute and deliver such instruments as it shall be advised by Counsel are requisite for that purpose and to release the Trust from its covenants herein contained (other than the provisions relating to the indemnification of the Debenture Trustee), upon proof being given to the reasonable satisfaction of the Debenture Trustee that the principal and premium (if any) of and interest (including interest on amounts in default, if any), on all the Debentures and all other monies payable hereunder have been paid or satisfied or that all the Debentures having matured or having been duly called for redemption, payment of the principal of and interest (including interest on amounts in default, if any) on such Debentures and of all other monies payable hereunder has been duly and effectually provided for in accordance with the provisions hereof.

Discharge. The Debenture Trustee shall at the written request of the Trust Corporation release and discharge this Indenture and the Security Documents and the Security Interest constituted thereby and execute and deliver such instruments as it shall be advised by Counsel are requisite for that purpose and to release the Trust Corporation from its covenants herein contained (other than the provisions relating to the indemnification of the Debenture Trustee), upon proof being given to the reasonable satisfaction of the Debenture Trustee that the principal and of, premium (if any) of and interest (including interest on amounts in default, if any), on all the Debentures and all other monies payable hereunder have been paid paid, satisfied or satisfied delivered or that all the Debentures having matured or having been duly called for redemption, payment of the principal of and interest (including interest on amounts in default, if any) on such Debentures and of all other monies payable hereunder has been duly and effectually provided for in accordance with the provisions hereof.

Discharge. The Debenture Trustee shall at the written request of the Trust Corporation release and discharge this Indenture and all security granted hereunder or under any other Indenture Document and execute and deliver such instruments as it shall be advised by Counsel are requisite for that purpose and to release the Trust Corporation from its covenants herein contained (other than the provisions relating to the indemnification of the Debenture Trustee), upon proof being given to the reasonable satisfaction of the Debenture Trustee that the principal and premium (of, premium, if any) of , and interest on (including interest on amounts in default, if any), on ) all of the Debentures and all other monies moneys payable hereunder have been paid or satisfied or that that, all of the Debentures having matured or having been duly called for redemptionredemption in accordance with Article 3, payment of the principal of of, premium, if any, and interest (including interest on amounts in default, if any) on such Debentures and of all other monies moneys payable hereunder has have been duly and effectually provided for in accordance with the provisions hereof.

Discharge. The Debenture Trustee shall at the written request of the Trust REIT release and discharge this Indenture and execute and deliver such instruments as it shall be advised by Counsel are requisite for that purpose and to release the Trust REIT from its covenants herein contained (other than the provisions relating to the indemnification of the Debenture Trustee), upon proof being given to the reasonable satisfaction of the Debenture Trustee that the principal of and premium (premium, if any) of , on and accrued and unpaid interest (including interest on amounts in default, if any), on all the Debentures and all other monies moneys payable hereunder have been paid or satisfied or that that, all the Debentures having matured or having been duly called for redemption, payment of the principal of and premium (if any) and interest (including interest on amounts in default, if any) on such Debentures and of all other monies moneys payable hereunder has been duly and effectually provided for in accordance with the provisions hereof.
