Disability Leave Bank Clause Samples
The Disability Leave Bank clause establishes a pooled reserve of leave days that employees can access in the event of a disability that prevents them from working. Typically, employees may contribute a portion of their own leave to the bank, and those who exhaust their personal leave due to a qualifying disability can apply to draw additional days from this shared resource. This clause ensures that employees facing extended medical absences have a safety net, promoting financial security and workplace support during periods of disability.
Disability Leave Bank. USD 500 shall establish a disability leave bank for teachers who choose to participate. The day-to-day administration of the bank shall be the responsibility of the District. This bank shall be governed by the following regulations:
1. Participation shall be voluntary. Those who choose to participate shall contribute one (1) day of their accumulated temporary disability leave to the bank at the beginning of their period of participation.
Disability Leave Bank. USD 500 shall establish a disability leave bank for teachers who choose to participate. The day-to-day administration of the bank shall be the responsibility of the District. However, the responsibility for determining whether a teacher is eligible for leave, is granted leave and the amount of any leave granted shall be the responsibility of a committee of no less than three (3) teachers appointed by the Association. The committee appointed by the Association shall sign a confidentiality agreement prior to serving as the leave bank representative and being granted access to confidential medical information regarding another teacher. This bank shall be governed by the following regulations:
1. Participation shall be voluntary. Those who choose to participate shall contribute one (1) day of their accumulated temporary disability leave to the bank at the beginning of their period of participation.
Disability Leave Bank. Officers may make an irrevocable donation of accrued Personal Days, Deferred Holiday, or Vacation Leave during the month of December to a personal Disability Leave Bank. Donations shall be made in 8-hour increments.
Disability Leave Bank. A. The Union and the University agree that the existing Disability Leave Bank shall continue.
B. Faculty Members who have completed one (1) academic year of employment with the University of Alaska shall participate in the Disability Leave Bank.
C. Each Faculty Member shall contribute two (2) days of that Faculty Member's accumulated disability leave in the first month of eligibility. Participating Faculty Members shall contribute one (1) accumulated disability leave day each September to the Disability Leave Bank after initial contribution. Thereafter, Faculty Members having more than four (4) days accumulated disability leave shall contribute two (2) days each time the bank is depleted.
D. A Faculty Member may withdraw disability leave days from the Disability Leave Bank immediately upon depletion of that Faculty Member's personal accumulation of sick leave. The Disability Leave Bank and Leave Share Program shall be the exclusive sources of additional sick leave for Faculty Members after depletion of their personal accumulation of sick leave.
E. A Faculty Member may withdraw a maximum of ninety (90) days for any one (1) disability or complications therefrom.
F. A Faculty Member withdrawing disability leave days from the bank shall not have to replace those days, except as a regular contributing member of the bank.
G. A two-member Disability Leave Bank Administration Committee is established to administer the Disability Leave Bank and develop recommended policies for the administration of the Disability Leave Bank and submit those recommendations to the President of the University annually. This committee shall include one (1) representative from the University and one (1) representative from the ACCFT. The committee may, upon agreement, permit a Faculty Member to withdraw more than ninety (90) days in special circumstances, as an exception to Article 8.5.E. The Disability Leave Bank is administered by the University.
