Common use of Differential Pay Clause in Contracts

Differential Pay. Education Code Section 44977 grants each certificated employee five school months of extended illness leave for which the employee receives the difference between his/her salary and the salary that is actually paid to a substitute or would have been paid had one been employed (“differential pay leave”). A certificated employee may receive only one five-month period per illness or injury and per year, regardless of the number of reasons for the leave. This leave does not accumulate. This leave runs consecutively after the 10 days of current year sick leave and accumulated sick leave.
