Design Plans and Specifications. Developer will agree to construct the Project substantially in accordance with the plans attached to this Agreement as Exhibit “A” (hereinafter “the Current Plans”) with respect to massing, setbacks, ground level retail space dimensions, internal residential and retail/commercial trash storage, design, and materials visible on the proposed building’s exterior, subject to any and all necessary modifications that may be required or requested in connection with obtaining any zoning ordinance(s), approval(s), and/or permit(s) from the City of Philadelphia and/or any other governmental agency (hereinafter, “Necessary Modifications”). Notwithstanding the foregoing, and subject to all such Necessary Modifications, the final plans for the Project shall have at least the following parameters:

Design Plans and Specifications. The Contractor shall strictly comply with any and all design plans and specifications provided to it by the District in connection with the materials and work. Failure to comply shall constitute a material breach of this Agreement. Contractor shall be responsible seeking clarification of any questions concerning design plans and specifications.
Design Plans and Specifications. 5.1.1 The Tollway shall prepare Project construction plans, specifications, estimates and contract documents for bidding purposes and obtain County approval of final plans, specifications, estimates and contract documents.
Design Plans and Specifications. West St. Xxxx shall be responsible for the design of the Project. West St. Xxxx shall hire a professional design consultant and prepare the plans and technical specifications for the Project, which shall be approved by St. Xxxx xxxxx to the advertisement of bids. Design Plans and Specifications. Tenant and Owner hereby approve the Conceptual Design Plans, as approved by the City's Architectural Review Commission. Agency, at its expense, shall cause the Designer to convert the Conceptual Design Plans into final drawings and specifications ("Design Plans and Specifications") consistent with the Conceptual Design Plans. The Design Plans and Specifications shall include specifications as to all materials that will be used in undertaking the Improvements and be otherwise sufficiently detailed to put out to bid the work of Improvements and to support application for all permits required in connection therewith. Upon completion and submittal of the Design Plans and Specifications to Tenant and Owner, Tenant and Owner shall have ten (10) business days to approve the Design Plans and Specifications in writing, and upon such approval by Tenant and Owner, the Design Plans and Specifications will become the property of Tenant. Tenant's and/or Owner's failure to approve or disapprove the Design Plans and Specifications within such time shall conclusively be deemed approval of the Design Plans and Specifications. Tenant shall carry out the work of Improvements at its own risk and shall be solely responsible for ensuring that the Improvements are constructed and installed in accordance with the Design Plans and Specifications and in compliance with all Federal, State and local law and code requirements. Tenant shall also comply with the requirements for tenant's work contained in the Property Lease. Agency shall have no liability arising out of its involvement in the production of the Conceptual Design Plans or the Design Plans and Specifications.

Design Plans and Specifications. The Contractor shall provide to Owner all documents indicated in Table Q-1 of this exhibit. The submittal of documents shall be in general accordance with the detailed schedule to be developed by the Contractor as part of the initial design process for the project. The Owner shall have the right to approve all documents in the table listed as "approval" and shall have the right to provide comments on all documents listed as "information." The following subsections provide detailed requirements for various documents to be developed by the Contractor.
