Common use of Design and Specifications Clause in Contracts

Design and Specifications. Notwithstanding any reviews, approvals, criticisms or modifications given by the Town or its consultants, neither the Town, the Director nor the Town’s Consulting Engineer shall in any way be responsible for the design drawings or the plans and specifications related to these Works and the Owner shall bear sole responsibility for the soundness of the engineering design and for ensuring that the works required to be done will function as intended and contemplated.
