DESCRIPTION OF THE DATA PROCESSING. 2.1 The Data Processing carried out by Scaleway for the purposes of this Data Processing Agreement relates only to the types of Personal Data and the categories of Data Subjects defined by the Client and under its sole responsibility. 2.2 Subject to any specific conditions explicitly defined in the Specific Conditions applicable to certain Services, it is specified that Scaleway's Services are generally not suitable for the Data Processing of personal health data in accordance with the certification imposed by French law ( articles L.1111-8 and seq. of the public health code). Likewise, Scaleway makes no guarantee that the Services are suitable for processing personal health data under any other applicable local legislation. Consequently, the Client undertakes not to process any personal health data through Scaleway Services that do not meet the requirements imposed by applicable legislation, except where (i) the legislation of the Client's country and (ii) the legislation applicable to the data processed by the Customer, allow the processing of such personal health data. In this case, the Client remains solely responsible for implementing all technical and organizational Security Measures necessary for the processing of personal health data as well as ensuring that the level of security required within the framework of such processing complies with the regulatory requirements of the country concerned. 2.3 The Client undertakes to provide Scaleway with the data referred to in this Data Processing Agreement for the purposes of the execution of the Contract and, if the Client is Data Controller, to document in writing any instructions concerning the Data Processing operated by Scaleway. Furthermore, the Client remains solely responsible for selecting Services that are adapted to its needs and to implement sufficient technical and organizational measures to protect its Personal Data, particularly in the event of Data Processing likely to result in a high risk for the rights and freedoms of the Data Subjects. 2.4 Scaleway undertakes to (i) guarantee the confidentiality of Personal Data and (ii) to ensure that all Employees and Sub-processors authorized to process Personal Data under this Data Processing Agreement respect the confidentiality of Personal Data. The obligation of confidentiality of Personal Data will remain in force for five (5) years following the expiration of the Contract.

DESCRIPTION OF THE DATA PROCESSING. 2.1 The Data Processing carried out by Scaleway for the purposes of this Data Processing Agreement relates only to the types of Personal Data and the categories of Data Subjects defined by the Client and under its sole responsibility. 2.2 The Customer is also responsible for the choice of Services used and in particular for their compatibility with the data processing it implements. When Scaleway offers Services adapted to particular types of processing, the Client must use the Services concerned, in particular when these processing operations are subject to specific regulations or standards (and more particularly, but not limited to, in the context of processing of health data or banking data). 2.3 The Client undertakes to provide Scaleway with the data referred to in this Data Processing Agreement for the purposes of the execution of the Contract and, if the Client is Data Controller, to document in writing any instructions concerning the Data Processing operated by Scaleway.   • Description of the service 10.1.1 Automatic transfer service implies a transfer by the bank of the funds from the client’s account without further consent of the client, on the basis of fixed amount determined by the client in its application form or of information provided by the client’s creditor to the bank on the client’s debt. 10.1.2 The parties agree that the payment order created (generated) by the bank for the purposes of automatic transfer services shall have the legal force equal to the document having been printed on the paper and executed by the person(s) authorized to manage of the account. 10.1.3 The bank shall carry out the automatic transfer services in accordance with requirements and conditions stipulated in this agreement, the application on registration for automatic transfer service and the sources disseminated by the bank. 10.1.4 For the purposes of obtaining automatic transfer services the client shall apply to the bank with the application as per paragraph 1.2 of this agreement.
