Density, Intensity, and Height. The maximum density, intensity, and height for any development on the Property shall be regulated by the Town’s Comprehensive Plan and Land Development Regulations. At the Property, the maximum residential density is 80 dwelling units per acre and the maximum height is 75 feet, pursuant to relevant procedures for TDRs and bonus height. The intensity of development is limited by setbacks, height, building length, and other provisions of the Land Development Regulations. The Town finds that the Project, as proposed, is consistent with the density, intensity, and height permitted under this Agreement.
