Demonstrators. The Dealer shall maintain at all times in good condition and running order for demonstration and loan to prospective purchasers, such numbers of the latest model of such lines or series of VEHICLES as are in accordance with Company GUIDES therefor.
Demonstrators. NewCo shall accept from Contributor and Contributor shall contribute to NewCo Contributor’s New Vehicles with an odometer reading in excess of 500 miles, but less than 5,000 miles (“Demonstrators”). The Demonstrator values will be the value for New Vehicles calculated pursuant to Section 2(b)(ii) above less $0.25 per mile in excess of 500 miles, but not to exceed $5,000.00 per Demonstrator.
Demonstrators. From time to time, Dealership may use one or more Vehicles for demonstration and promotional purposes (“Demonstrator”), pursuant to the following additional terms and conditions:
Demonstrators. At the Closing, the Buyer shall purchase all of the Seller's untitled new motor vehicles (meaning current model year vehicles as of the Closing Date, but in any event including all 1999 model year vehicles) in the Seller's stock and unsold by the Seller as of the Closing Date which are used in the ordinary course of business for the purpose of demonstration, and that are listed on Schedule 3.2, which schedule the Seller shall deliver to the Buyer no more than three (3) days prior to the Closing (the "DEMONSTRATORS"). For purposes of this Agreement, any such vehicle with more than 500 miles, but fewer than 6,000 miles, on its odometer shall be deemed a "Demonstrator." Any motor vehicle with more than 6,000 miles on its odometer and any 1998 or prior model year (as of the Closing Date) new motor vehicle shall be deemed to be "used" rather than a "Demonstrator" or "New Vehicle". The purchase price to be paid by the Buyer for each Demonstrator shall be the price at which the Demonstrator was invoiced to the Seller by the respective Manufacturer, as adjusted pursuant to this Article III, and as reduced by an amount equal to ten cents ($.10) multiplied by the total mileage on the odometer (the sum of all such amounts to be paid for Demonstrators hereunder is herein referred to as the "DEMONSTRATOR PURCHASE PRICE"). Schedule 3.2 shall set forth each Demonstrator's model, invoice cost, odometer reading and all other information necessary to calculate the Demonstrator Purchase Price with respect to such Demonstrator.
Demonstrators. (d) Sales persons employed in the building of special displays. End displays on regular store fixtures shall not be considered as special displays except that sales persons may assist in the design and decoration of such displays, provided that replenishing of merchandise shall be performed by employees of the Co-operative. "Sales persons", for the purposes of this section, shall mean persons other than employees of the Co- operative. To further ensure compliance by sales persons with the immediately preceding paragraph, the Co- operative agrees to write to all the employers of sales persons, informing them that sales person who persist in violating the provisions of the foregoing paragraph will be excluded from the store of the Co-operative concerned. When there is a violation of the Clerk's Work Clause in the store, the Union will provide a written warning to the Store Manager, with copies to the Labour Relations and Human Resources Managers. In the case of a subsequent violation in that particular store within twelve (12) months of the written warnings (by any Sales Representative regardless of the Co- operative), the Co-operative will pay a fine of two hundred ($200.00) dollars. Such fine will be paid by the Co-operative to the United Food and Commercial Workers Canada Union, Local No. 401, (i) 50% to Dental Care Plan
Demonstrators. All work connected with or incidental to the demonstration of merchandise offered for sale in the Employer’s retail store (except mer­ chandise referred to in Section 1 (b) hereof as being excluded from this Agreement) shall be covered by this Agreement, and all such work shall be performed only by members of the appropriate unit as defined in Section 1 (a) hereof. No Demonstrator may perform such work in the Employer’s retail store unless said Demonstrator is on the payroll of the Employer, party hereto or a licensee of said Employer, and unless the Employer at all time holds and exercises full control of the terms and conditions of employment of any such Demonstrators while such work is being performed in the Employer’s retail store. Demonstrators shall be covered by all the terms of this Agreement. All em­ ployees classified as Demonstrators on May 1, 1964 shall be paid on the basis of the Regular Clerk’s rate of pay.
