Delivery Rates. Seller shall have agents or employees available at all reasonable times to receive from Buyer’s dispatchers advice and requests for changes in the rates of delivery of gas as required by Buyer from time to time.
Delivery Rates. The Fresh Water System, including the Impoundment Facilities, will be designed to permit Fresh Water to be made available at the points on interconnection with the High-Rate Transfer Facilities at a minimum flow rate of 60 Barrels per minute, assuming that Fresh Water will be made available for hydraulic fracturing operations on only one Well per trunkline at any given time (the “Minimum Flow Rate”).
Delivery Rates. Transporter and Shipper shall endeavor to deliver and to accept, respectively, Carbon Dioxide in as reasonable constant rates as is practicable. Transporter and Shipper understand and agree that the amount of Carbon Dioxide delivered hereunder from time to time may not exactly equate with the volume of Carbon Dioxide requested for delivery hereunder since variations may occur due to the inherent fluctuations in normal pipeline operations. Upon request from Shipper, Transporter may deliver Carbon Dioxide on any day in excess of the Daily Maximum Quantity, but Transporter shall not be obligated to do so.

Subject to the other provisions of this Agreement, Midstream Co shall construct and operate each Individual System in a manner so as to permit Fresh Water to be made available at the Delivery Points at delivery rates equal to or greater than the Maximum BPM Rate specified on the applicable Midstream Agreement Addendum.
Delivery Rates. Buyer and Seller recognize that due to actual operating conditions, the delivery or receipt of Product may not necessarily be of a constant rate. HECO shall use reasonable commercial efforts to make conforming Nominations to facilitate such planning.
