Delivery of Products and Services. In the event of a strike, sympathy strike, picketing, work stoppage, slowdown, demonstration, or any other lawful or unlawful disruptive activity that impacts Services, Vendor shall ensure continued undisrupted delivery of Services and products to the Board in accordance with the terms of the Agreement, or as may be otherwise directed by the Board. Under the aforementioned circumstances, the Board shall have the right to direct Vendor to use any of the following methods to arrange for continued delivery of products and Services: 1) use of Vendor’s non-union employees or an alternative courier to deliver products; 2) delivery of products to an alternative site; 3) use of Board employees to pick up products from Vendor or Vendor’s couriers; or 4) any other alternative means necessary to ensure that products and Services are timely delivered to the Board without disruption (subject to all applicable professional practice laws). Vendor shall also enforce any no-strike clauses Vendor has in its collective bargaining agreements when such clauses impact the delivery of any Services or products under this Agreement. Any alternative delivery methods utilized under this Section shall be approved by a representative designated by the Board.

LTC will use all reasonable endeavours to ensure that you receive access to the ICAS AssessmentsTM on the day selected in the Eventbrite registration page.
Delivery of Products and Services. The term of each Service Order begins on the later of (a) the requested date for Services or Products or (b) the date when Services or Products are first delivered to Customer (the “Effective Date”). If Customer cancels a Service Order before the Effective Date, then Customer shall pay the Equipment Fee plus a cancellation cost of $35 per voice line, and $750 for high speed Internet services. Hotwire may terminate Services without further liability to Customer, upon written notice to Customer, if underlying facilities or services required by Hotwire to provide Services become unavailable or if the price of the underlying services or facilities increases to the extent that continued provisioning of Services becomes commercially unreasonable, as determined in Hotwire’s sole discretion. The Service may include use of certain equipment owned by Hotwire and located at the Customer’s premises (“Hotwire Equipment”), but title to the Hotwire Equipment will remain with Hotwire. Customer must provide electric power for the Hotwire Equipment, must keep the Hotwire Equipment physically secure and free from liens and encumbrances and will bear the risk of loss or damage, other than ordinary wear and tear, to Hotwire Equipment. 5. SERVICE SUSPENSION. Hotwire may suspend or terminate Services if: (a) Customer’s payment is rejected or Customer does not pay all amounts by the due date upon ten (10) days’ notice, or longer notice if required by state law; (b) Customer violates the Hotwire policies posted at xxx.xxxxxxxxxx.xxx; (c) Customer becomes insolvent or bankrupt; or (d) Customer is involved in suspected or actual fraud, misrepresentation, or other violation of law (“Cause”). 6.
Delivery of Products and Services. The supply of products and services are provided by Xxxx Xxxxx Photography on a best endeavours basis. Xxxx Xxxxx Photography will not be liable for delays that are beyond reasonable control. Xxxx Xxxxx Photography shall use reasonable endeavours to meet agreed deadlines where applicable. Xxxx Xxxxx Photography shall not be liable for any delays in meeting any obligations which were due to causes beyond his reasonable control including but not limited to: postage/courier; war/acts of terrorism; riots; government legislation; industrial action; adverse weather conditions; acts of God; floods; fire; loss or damage in transit; etc.
