Delegate Rights Clause Samples
Delegate Rights. (a) Healthscope will allow Delegates to perform their Delegate role without discrimination or adverse treatment.
(b) Healthscope recognises and respects that authorised Delegates speak on behalf of the Union’s members in the workplace.
(c) Healthscope will allow Delegates:
(i) reasonable access to telephone, facsimile, photocopying, internet and email facilities for the purpose of carrying out the Delegate activities in clause 40.3 below; and
(ii) place Union information on a notice board in a prominent location in their workplace.
(d) In the event that Delegates wish to undertake a secondment to the union to undertake the activities set out in clause 40.3(a) below, they can apply to Healthscope management for paid leave, using their accrued annual leave or long service leave entitlements (where long service leave is available to the Delegate to access), or an unpaid leave of absence.
(e) Delegates seeking approval for leave to undertake the activities in clause 40.3(a) below must seek and receive management approval prior to taking leave. Approval will be subject to operational requirements.
(f) Any unpaid leave of absence granted by Healthscope under clause 40.2(d) above will count as service for all purposes of this Agreement.
Delegate Rights. All employees who are members of the UWU shall be entitled to elect union delegates to represent them. The employer shall recognise elected union delegates as the on site representative of the union. The union will be given reasonable opportunity to recruit new workers as members. The delegate will be provided reasonable time to conduct site related union business on or off site subject to prior and acceptable arrangements with Management. The Company agrees to the use of notice boards by the union delegate or by the union to post notices on.
Delegate Rights. (a) Masterpet recognises the Union delegate(s) who are elected by the employees as the on- site representatives of the Union, and whose names have been forwarded in writing to Masterpet by the appropriate Union.
(b) Delegates on-site business
(i) Delegates of the Union will be allowed, such paid time as is necessary to conduct legitimate on-site Union business with employees, Masterpet or Masterpet's representative. Delegates shall have reasonable access to resources to perform their role, including access to a private meeting room and telephone. Access to email will also be provided as long as its use is responsible and for reasonable Union purposes only. A specific computer will be allocated for this purpose.
(ii) Wherever possible, this on-site business shall be conducted at times that are suitable to the relevant Manager/Supervisor and Delegate(s). The Union or the delegates will have access to new employees during the induction process.
Delegate Rights. 4.1 The Employer recognises the Union Delegates who are elected by the employees as the on-site representatives of the UWU
Delegate Rights. (a) This clause provides for the exercise of the rights of workplace delegates set out in section 350C of the Act . NOTE: Under section 350C(4) of the Act , the employer is taken to have afforded a workplace delegate the rights mentioned in section 350C(3) if the employer has complied with this clause.
(b) In this clause :
Delegate Rights. 38.137.1 The employer will recognise delegates, chosen by employees as the Union representatives.
Delegate Rights. (a) HCL recognises the Union delegate(s) who are elected by the Employees as the on-site representatives of the Union, and whose names have been forwarded in writing to HCL by the appropriate Union.
(b) Delegates’ on-site business Delegates of the Union will be allowed, such paid time as is necessary to conduct legitimate on-site Union business with Employees, HCL or HCL's representative. Delegates shall have reasonable access to resources to perform their role, including access to a private meeting room and telephone. Access to email will also be provided as long as its use is responsible and for reasonable Union purposes only. A specific computer will be allocated for this purpose.
(c) Wherever possible, this on-site business shall be conducted at times that are suitable to the relevant manager/supervisor and delegate(s).
(d) Taking into account, 47.2(c), the Union will be provided with up to 4 hours per annum to meet with its members, noting that any such meeting will be no longer than 30 minutes, unless mutually agreed between the Union and HCL.
(e) The Union or its delegates will be given adequate paid time to meet with new Employees and labour hire casuals for the purposes of introducing and explaining this Agreement and Union matters. Except where otherwise agreed, this will occur at the induction of such persons.
Delegate Rights. Right of Representation
(a) Without limiting any of the rights of representation otherwise provided under this Enterprise Agreement, a Workplace Delegate may represent the industrial interests of eligible employees who wish to be represented by the workplace delegate in matters including:
(i) Consultation about a major workplace change;
(ii) Consultation about changes to rosters or hours of work;
(iii) Resolution of disputes;
(iv) Disciplinary processes;
(v) Bargaining for a new enterprise agreement to replace this agreement where the Workplace Delegate has been appointed as a bargaining representative under section 176 of the Act or is assisting the delegate’s organisation with enterprise bargaining; and
(vi) Any process or procedure within this Agreement or a policy of WFG under which employees are entitled to be represented and which concerns their industrial interests
(b) A Workplace Delegate may communicate with employees for the purpose of representing their industrial interests under clause 7.6(a). This includes discussing membership of the AWU and representation with employees.
(c) A Workplace Delegate may communicate with employees during working hours or work breaks, or before or after work.
(d) WFG will provide a Workplace Delegate with access to or use of the following workplace facilities:
(i) A room or area to hold discussions that is fit for purpose, private and accessible by the Workplace Delegate and employees;
(ii) A physical or electronic noticeboard;
(iii) Electronic means of communication ordinarily used in the workplace by WFG to communicate with employees and by employees to communicate with each other, including access to Wi-Fi;
(iv) A lockable filing cabinet or other secure document storage area; and
(v) Office facilities and equipment including printers, scanners and photocopiers.
(e) WFG is not required to provide access to or use of a workplace facility under clause 7.6(d) if:
(i) The workplace does not have the facility;
(ii) Due to operational requirements, it is impractical to provide access to or use of the facility at the time or in the manner it is sought; or
(iii) WFG does not have access to the facility at the enterprise and is unable to obtain access after taking reasonable steps.
(f) WFG will provide a Workplace Delegate with access to up to 5 days of paid time during normal working hours for initial training and at least one day each subsequent year, to attend training related to representation of the industrial inter...
Delegate Rights. 41.1. The Employer acknowledges that Union delegates and other employee representatives have an important role to represent and speak on behalf of members in the workplace and that their representation rights in relation to matters that pertain to the employment relationship are integral to the proper operation of the Dispute Settlement Procedure contained at clause 15 of this Agreement.
41.2. The Employer will treat delegates and other employee representatives fairly and to allow them to perform their role without any discrimination in their employment. The employer recognises and respects that endorsed union delegates speak on behalf of Union members in the workplace.
Delegate Rights. The Company shall recognise the Union Delegate(s) who are elected by the employees, or appointed by the SDA, as the on-site representative(s) of the SDA, and whose name(s) have been forwarded in writing to the Company by the SDA.
