Delays during construction. Without prejudice to the provisions of Clause 10.3 (ii), in the event the Contractor does not achieve any of the Project Milestones or the Authority’s Engineer shall have reasonably determined that the rate of progress of Works is such that Completion of the Project Highway is not likely to be achieved by the end of the Scheduled Completion Date, it shall notify the same to the Contractor, and the Contractor shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.

Without prejudice to the provisions of Clause 10.3 (ii)10.2.2, in if the event the Contractor Implementation Agency does not achieve any of the Project Milestones or the Authority’s Engineer Project Consultant or the Authority shall have reasonably determined that the rate of progress of Construction Works is such that Completion of the Project Highway is not likely to be achieved completed by the end of the Scheduled Completion Date, it shall notify the same Implementation Agency to the Contractorthis effect, and the Contractor Implementation Agency shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer Authority and the Project Consultant in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion DateCOD.

Without prejudice to the provisions of Clause 10.3 (ii)12.4.2, in if the event the Contractor Concessionaire does not achieve any of the Project Milestones or the Authority’s Independent Engineer shall have reasonably determined that the rate of progress of Construction Works is such that Completion of the Project Highway [Six-Laning] is not likely to be achieved by the end of the Scheduled Completion [Six-Laning] Date, it shall notify the same Concessionaire to the Contractorthis effect, and the Contractor Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Independent Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.

Without prejudice to the provisions of Clause 10.3 (ii)10.3.2, in the event the Contractor does not achieve any of the Project Milestones or the Authority’s Engineer shall have reasonably determined that the rate of progress of Works is such that Completion of the Project Highway is not likely to be achieved by the end of the Scheduled Completion Date, it shall notify the same to the Contractor, and the Contractor shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.

Delays during construction. Without prejudice to the provisions of Clause 10.3 (ii)10.3.2, in the event the Contractor does not achieve any of the Project Milestones within the time period stipulated in Schedule I or the Authority’s Engineer shall have reasonably determined that the rate of progress of Works is such that Completion of the Railway Project Highway is not likely to be achieved by the end of the Scheduled Completion Date, it shall may notify the same to the Contractor, and the Contractor shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.

Without prejudice to the provisions of Clause 10.3 (ii)12.3.2, in the event if the Contractor does not achieve any of the Project Milestones or the Authority’s Engineer Engineer-in charge shall have reasonably determined that the rate of progress of Construction Works is such that Completion of the Project Highway is not likely to be achieved completed by the end of the Scheduled Completion Date, it shall notify the same Contractor to the Contractorthis effect, and the Contractor shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer Engineer-in-charge in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion DateCOD.

Without prejudice to the provisions of Clause 10.3 (ii)12.4.2, in if the event the Contractor Concessionaire does not achieve any of the Project Milestones or the Authority’s Independent Engineer shall have reasonably determined that the rate of progress of Construction Works is such that Completion of the Project Highway Two- Laning is not likely to be achieved by the end of the Scheduled Completion Two-Laning Date, it shall notify the same Concessionaire to the Contractorthis effect, and the Contractor Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Independent Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.

Without prejudice to the provisions of Clause 10.3 (ii)12.4.2, in if the event the Contractor Concessionaire does not achieve any of the Project Milestones or the Authority’s Independent Engineer shall have reasonably determined that the rate of progress of Construction Works is such that Completion of the Project Highway Two-Laning is not likely to be achieved by the end of the Scheduled Completion Two-Laning Date, it shall notify the same Concessionaire to the Contractorthis effect, and the Contractor Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Independent Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.

Without prejudice to the provisions of Clause 10.3 (ii)12.6.1, in if the event the Contractor Concessionaire does not achieve any of the Project Milestones or the Authority’s Engineer Independent Expert shall have reasonably determined that the rate of progress of Construction Works is such that Completion completion of the Project Highway is not likely to be achieved by the end of the Scheduled Completion Date, it shall notify the same Concessionaire to the Contractorthis effect, and the Contractor Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer Independent Expert in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Milestone or Project Completion Date, as the case may be.

Without prejudice to the provisions of Clause 10.3 (ii)11.3.2, in the event the Contractor Concessionaire does not achieve any of the Project Milestones within the time period stipulated in Schedule -H or the Authority’s Engineer shall have reasonably determined that the rate of progress of Works is such that Completion of the Project Highway is not likely to be achieved by the end of the Scheduled Completion Date, it shall may notify the same to the ContractorConcessionaire, and the Contractor Concessionaire shall, within 15 (fifteen) days of such notice, by a communication inform the Authority’s Engineer in reasonable detail about the steps it proposes to take to expedite progress and the period within which it shall achieve the Project Completion Date.
