Delayed Determination Sample Clauses

The Delayed Determination clause establishes that a decision or calculation relevant to the contract will be made at a later specified time rather than immediately. In practice, this clause might apply to situations where certain information is not yet available, such as final pricing, performance metrics, or regulatory approvals, and the parties agree to defer the determination until those details are clear. Its core function is to provide flexibility and ensure that important decisions are based on complete and accurate information, thereby reducing the risk of premature or uninformed commitments.
Delayed Determination. When the employee’s ALOC is delayed because the employee (a) 90 Day Review. Has not served 90 days under performance standards; or
Delayed Determination. (a) A delay in determination must be made when: (1) an employee has not had ninety (90) calendar days to demonstrate acceptable performance because he or she has not been informed of the specific requirements for performance at an acceptable level of competence in his or her current position, and the employee has not been given a performance rating in any position within ninety (90) calendar days before the end of the waiting period; or (2) the employee has been reduced in grade because of unacceptable performance to a position in which he or she is eligible or will become eligible for a within-grade increase within ninety (90) calendar days. (b) When an acceptable level of competence determination has been delayed under this Section, the employee shall be informed that his or her determination is postponed, that the appraisal period is extended, and of the specific requirements for sustained performance at an acceptable level of competence. The acceptable level of competence determination shall be based on a Rating of Record completed at the end of the ninety (90) calendar day minimum appraisal period established consistent with Article 13 (Performance Rating).

Delayed Determination. When the employee’s ALOC is delayed because the employee (a) 90 Day Review. Has not served 90 days under performance standards; or (b) New Position. The employee was reduced in grade because of poor performance and has not served 90 days under performance standards in the new position. However, an employee’s within-grade-increase will not be delayed under (2) (a) solely because the Agency has made changes to an employee’s performance standard. If a within grade is delayed under (2) and the employee is subsequently found to be performing at an ALOC, the increase will be granted retroactively to the beginning of the pay period following the completion of the waiting period.
