Common use of Delayed Appraisal Clause in Contracts

Delayed Appraisal. If the adjusted Rent has not been determined by independent appraisal, the Lessee shall continue to pay all Rent(s) and their respective increase(s), subject to the CPI Escalation as provided in Section 4.1.2 above. Following the determination of the Rent by independent appraisal, the Rent will be adjusted as provided retroactively to the commencement of the respective review Term and the Lessee shall pay to the Lessor with the next installment of Rent due, the amount, if any, by which the Rent, as adjusted, exceeds the Rent that has been paid by the Lessee for the retroactive period.
