Defined Conditions. The terms described in this Article I and parenthetically elsewhere have the same meaning in this Agreement. Defined terms can be used in the singular and plural. Definitions in this Agreement should only define or limit the scope of this Agreement and should not be construed as defining or limiting the scope of other agreements between the parties, or a letter patent, copyrights, trademarks or other property rights. All terms that are not defined in this are defined differently have their ordinary meaning. 1 <PAGE> (a) confidential information: all knowledge, or information which RSI has not provided to the general public in relation to its activities and which is provided or otherwise made available to XXXXX d/b/a DCR in accordance with or in connection with this Agreement, including confidential information provided by RSI </PAGE> </PAGE> xxxxx d/b/a DCR before the date of this Agreement.   • CONCEALED CONDITIONS 12.2.1 Should concealed conditions encountered in the performance of the Work below the surface of the ground, or should concealed or unknown conditions in an existing structure be at variance with the conditions indicated by the Contract Documents or should unknown physical conditions below the surface of the ground or should concealed or unknown conditions in an existing structure of an unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent in work of the character provided for in this Contract, be encountered, the Contract Sum shall be equitably adjusted by Change Order upon claim by either party made within twenty days after the first observance of the conditions.
