Common use of Defense Costs Clause in Contracts

Defense Costs. The limits of indemnity coverage required under Section 10. shall not include costs incurred in defending against a claim and shall not be reduced by the payment of such costs; provided, however, that with respect to professional liability coverage as set forth in Section 10., Vendor may alternatively maintain coverage with minimum limits of $2 million per claim and $4 million in the aggregate.

Defense Costs. The limits of indemnity coverage required under Section 109.1. shall not include costs incurred in defending against a claim and shall not be reduced by the payment of such costs; provided, however, that with respect to professional liability or Cyber/Network Security coverage as set forth in Section 10.Sections 9.1.7, Vendor may alternatively maintain coverage with minimum limits of $2 5 million per claim and $4 5 million in the aggregate.

The limits of indemnity coverage required under Section 108. shall not include costs incurred in defending against a claim and shall not be reduced by the payment of such costs; provided, however, that with respect to professional liability coverage as set forth in Section 108., Vendor may alternatively maintain coverage with minimum limits of $2 million per claim and $4 million in the aggregate.

The limits of indemnity coverage required under Section 1010.1. and 10.2. shall not include costs incurred in defending against a claim and shall not be reduced by the payment of such costs; provided, however, that with respect to professional liability coverage as set forth in Section 1010.1.5., Vendor may alternatively maintain coverage with minimum limits of $2 3 million per claim and $4 million in the aggregate.

The limits of indemnity coverage required under Section 1011.1. shall not include costs incurred in defending against a claim and shall not be reduced by the payment of such costs; provided, however, that with respect to professional liability coverage as set forth in Section 10.11.1.4, Vendor may alternatively maintain coverage with minimum limits of $2 million per claim and $4 million in the aggregate.
