Defects in the Software. 10.1. Broetje-Automation GmbH performs any and all deliveries and services in accordance with state-of-the-art technology. However, state-of-the-art technology does not make it possible to develop complex software products which are completely free of errors. The agreed characteristics of the software provided by Broetje-Automation GmbH consequently do not warrant that no program errors of any kind will occur, but solely that the software does not contain any program errors which would cause any major impairments in the proper usability of the software.

Defects in the Software. 6.1 SecMaker warrants that the Software, for a period of three (3) months after the date of installation, materially conforms to the Specification, subject to any amendments due to Updates and Upgrades, provided that: (i) the Customer has only used the Software in accordance with Section 2 above; (ii) the Customer has not used the Software in an incorrect or negligent manner; (iii) any defect in the Software is not caused by hardware, software, data, documentation or other equipment which has not been delivered by SecMaker; (iv) the Software has not been modified or used in a way deviating from its intended purpose; or (v) the defect in the Software does not merely affect the Customer’s use of the Software in an insignificant manner.

  • SERVICE MONITORING, ANALYSES AND ORACLE SOFTWARE 11.1 We continuously monitor the Services to facilitate Oracle’s operation of the Services; to help resolve Your service requests; to detect and address threats to the functionality, security, integrity, and availability of the Services as well as any content, data, or applications in the Services; and to detect and address illegal acts or violations of the Acceptable Use Policy. Oracle monitoring tools do not collect or store any of Your Content residing in the Services, except as needed for such purposes. Oracle does not monitor, and does not address issues with, non-Oracle software provided by You or any of Your Users that is stored in, or run on or through, the Services. Information collected by Oracle monitoring tools (excluding Your Content) may also be used to assist in managing Oracle’s product and service portfolio, to help Oracle address deficiencies in its product and service offerings, and for license management purposes.

  • Service Warranty Provider has carefully examined and analyzed the provisions of this Agreement, including but not limited to all exhibits attached and incorporated into it, and can and will perform, or cause, the Services to be performed in strict accordance with the provisions and requirements of the Agreement.
