Common use of Default and Enforcement Clause in Contracts

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 11.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay following a demand for payment in accordance with Section 11.07 10.01 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsamounts owed under its Guarantee and this Article 10.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 11.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

If any Guarantor fails to pay in accordance with Section 11.07 8.01 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

If any Guarantor fails to pay in accordance with Section 11.07 11.06 hereof, subject to the provisions of the Intercreditor Agreement (if any), the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

If any the Guarantor fails to pay or deliver in accordance with Section 11.07 16.01 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such the Guarantor and such the Guarantor’s obligations Guarantee Obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such the Guarantor the obligationsGuarantee Obligations.

If any Guarantor fails to pay in accordance with Section 11.07 12.01 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

If any Guarantor fails to pay in accordance with Section 11.07 17.01. hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any the Guarantor fails to pay in accordance with Section 11.07 11.5 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such the Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such the Guarantor the obligationsIndenture Obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 14.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations 's Obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsGuaranteed Obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 1401 or Section 1410 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee Subsidiary Guarantees of any such Guarantor and such Guarantor’s each other Guarantor of the Guarantors’ obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsGuarantors the obligations of the Company under the Securities and this Indenture.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 11.01 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

If any the Guarantor fails to pay in accordance with Section 11.07 3.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such a particular series of Notes of the Guarantor and such the Guarantor’s obligations thereunder and hereunder with respect to that series of Notes by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such the Guarantor the obligations.

If any Guarantor fails to pay in accordance with Section 11.07 11.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Subsidiary Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 1401 or Section 1410 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee Subsidiary Guarantees of any such Guarantor and such Guarantor’s each other Guarantor of the Guarantors' obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsGuarantors -164- the obligations of the Company under the Notes and this Indenture.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 16.5 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 11.6 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 13.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

If any Guarantor fails to pay in accordance with Section 11.07 10.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder under this Indenture by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

If any Guarantor fails to pay in accordance with Section 11.07 10.1 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any the Guarantor fails to pay in accordance with Section 11.07 1306 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee Guarantees of any such the Guarantor and such the Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such the Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 12.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note its Guarantee of any such Guarantor and such Guarantor’s obligations 's Obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsIssuer's Obligations under this Indenture and the Senior Notes.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.. 105

If any Guarantor fails to pay in accordance with Section 11.07 11.6 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Subsidiary Guarantee of any 107 such Guarantor and such Guarantor’s 's obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 10.07 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Subsidiary Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any a Guarantor fails to pay in accordance with Section 11.07 14.06 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee Guarantees of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsGuarantors the Obligations.

Default and Enforcement. If any the Guarantor fails to pay in accordance with Section 11.07 10.05 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such the Guarantor and such the Guarantor’s obligations thereunder and hereunder by any remedy provided 104 by law, whether by legal proceedings or otherwise, and to recover from such the Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 12.6 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligations.

Default and Enforcement. If any Guarantor fails to pay or deliver in accordance with Section 11.07 11.01 hereof, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations Guarantee Obligations thereunder and hereunder by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsGuarantee Obligations.

Default and Enforcement. If any Guarantor fails to pay in accordance with Section 11.07 hereofany amount hereunder or under any Guarantee, the Trustee may proceed in its name as trustee hereunder in the enforcement of the Note Guarantee of any such Guarantor and such Guarantor’s obligations thereunder hereunder and hereunder under any Guarantee by any remedy provided by law, whether by legal proceedings or otherwise, and to recover from such Guarantor the obligationsall amounts due.
