Dedicated Reserves. This comprises reserves established through legislation for conservation purposes such as National Parks, State Parks and Flora and Fauna Reserves.

Dedicated Reserves. Subject to Producer’s Reservations and to the other terms and conditions of this Agreement, Producer (i) exclusively dedicates and commits to the performance of this Agreement the Dedicated Reserves, (ii) represents that the Dedicated Reserves are not otherwise subject to any other gas gathering agreement or commitment and (iii) agrees not to deliver any Gas produced from the Dedicated Reserves and owned by Producer to any other gas gatherer, processor, or gas gathering system. Producer possesses the right to deliver the Dedicated Reserves to the Gathering System. Producer agrees to cause any existing or future Affiliates of Producer holding Dedicated Reserves to be bound by, and to execute and join as a party, this Agreement. The dedication and commitment made by Producer under this Agreement is a covenant running with the land.

Dedicated Reserves. The coal contained within the Coal Leases is dedicated exclusively to production for the San Xxxx Station and shall not be sold to any third party. Before SJCC acquires any coal leases contiguous with the Coal Leases, SJCC will offer to dedicate such coal leases to production for the San Xxxx Station under the terms of this Agreement. Upon approval (which approval shall not be withheld unreasonably) by the Joint Committee of the terms for incorporating such leases into this Agreement (including any necessary adjustments to Section 8.1 to account for any new taxes, royalties or other costs associated with such new leases), those coal leases if acquired, will become dedicated to production for the San Xxxx Station except as provided otherwise herein. SJCC shall not mine coal from the coal leases described in the Cimarron Coal Assignment.
Dedicated Reserves. As to the acceptability of the Dedicated Reserves, Buyer and Financing Parties shall rely on their own independent estimates, their own evaluation of the Reserve Reports provided by Seller, other evaluation, studies, inspections, and review of the xxxxx, acreage, and the Gas available for delivery therefrom. It is expressly understood that the determination whether conditions permit or justify the drilling of any new xxxxx shall be made by Seller or Owner in its sole discretion, and that nothing in this Agreement shall be interpreted as a requirement or obligation on Seller's or Owner's part to conduct any new drilling at any time.

Dedicated Reserves no Loan Party has done any act or thing, nor is aware of any act or thing having been done, whereby material Dedicated Reserves have been released from dedication or material amendments, restrictions or alterations made to any dedication covenants in respect thereof;
